FOR IMMEDIATE RELEASE August 28, 2020 Re: Officer Involved Shooting Of Sandra Harmon On May 5, 2020 The District Attorney’s Office has completed its investigation into the shooting of Sandra Harmon on May 5, 2020 in Half Moon Bay during a confrontation with San Mateo County Sheriff’s Deputies David Dominguez and John Baba in the parking lot of the Pasta Moon restaurant at 845 Main Street in Half Moon Bay. After a thorough investigation by Inspector James Haggarty and other inspectors with the San Mateo County District Attorney’s Office, District Attorney Stephen M. Wagstaffe has concluded that while this is a tragic incident with a very sad outcome, there is no legal basis for filing criminal charges against Deputies Dominguez and Baba. District Attorney Wagstaffe has concluded that the use of force by the deputies against Sandra Harmon was legally justifiable self-defense pursuant to California Penal Code section 835a and section 196. Therefore this case is now deemed closed by this office. The letter written by District Attorney Wagstaffe to San Mateo County Sheriff Carlos Bolanos setting forth the basis for the decision declining to file criminal charges in this case is attached to this e-mail press release.
