Dear Hon. Judge Leland Davis III on November 22, 2021, You cancelled the Public Telephone Access to the San Mateo County Courts. I’m asking you to reverse that decision.
Public Access Policy Updated 11/22/21 – The listen-only public access lines are no longer in effect; proceedings are open to the public to attend in person.
As you can see by the Alert issued today, It would be safer for the Public to listen on the phone.
COVID ALERT FOR
SAN MATEO COUNTY, CALIFORNIA
RISK INCREASED
on 12/23/2021Note that risk is reduced for those who are vaccinated.
Making San Mateo County Safer and Eliminating Corruption has been a project of mine for over 20 years now. I support the Public and Community in the Recall of the Daly City Elected Officials. It is exactly what Jeff Regan recommended shortly after Roger Allen R.I.P. was killed by the Daly City Police Officers who claimed all 4 of them were surrounding the disabled truck with a Flat Tire because “They were there to Help.”
Bay Area Transparency Video made 1 year ago tomorrow, Roger Allen R.I.P. was killed April 7, 2021, 96 days after this video was made. Now I got to see the “We are here to help.” in action. Roger Allen R.I.P. also saw it.
A while ago, We personally reached out to Talika, Roger Allen’s Sister, to express our sorrow and outrage for his murder. And also to offer love and support for Her, Her Family and the Community. We remain steadfast on the resignations of ALL Daly City Council Members and the disposal of the City Manager and Assistant City Manager. They are truly trash! We have been active in sending very pointed and directed email messages and verbal comments to all Council Members as well as the City Manager demanding their departures. We have called dc officials out as racists, murderous cowards. We have verbally vanquished them to Hell. Dropping a few f bombs on them on the way. We verbally broke the DCPD chief and captain in prior meetings as well as moderator leilani ramos and most recently demolishing council member buenaventura. We have reminded them, all Meetings are their LEGACY for their current and future generations to view them as the trash they are. This is pure demonic cowardice evil. We would like to connect with Community Leaders and Community Organizations in an effort to begin a RECALL effort in early 2022. We think it would be best to connect as a Whole Community. Strength in Numbers!! We would be more than happy to support all efforts to begin:“Recall the Racist, Murderous DC Council Members.” More than happy to put the banners together. Please let us know if ALL of us can come together on this. We can connect in early 2022 after the Holidays and as DC City Council Meeting has been moved to Jan 10th, 2022 another display of their cowardice. Finally, it really hit us hard as many of us, if not all, have our Family with us this Holiday Season and Talika and Ms. Wright do not have Roger with them
Please let us know your thoughts of change for a better, safer Daly City in 2022. Best Regards. The Public and Community
Most residents in San Mateo County don’t know that the behavior of the Police Department is the responsibility of the City Manager. The voters of Daly City can not recall the City Manager, The City Council can Fire/Terminate her if they wish too, they don’t. So the only option is to RECALL the Councilmembers.
You may remember the Residents of Foster City, San Mateo County, California recently Successfully RECALLED Herb Perez the vice mayor. You can just imagine how many Political Experts thought that was terrible Idea.
There are many families in San Mateo County who have lost loved ones to Homicide by Law Enforcement. Please keep them in your thoughts.
If you are interested in joining The Public and Community in this effort you can send me your contact information at michaelgstogner@yahoo.com and I will pass it on.
Today December 22, 2021 Courtroom 8B at 9:00AM Hon. Judge Chinhayi C. Cadet for Arraignment
SMCCCD Vice Chancellor Jose D. Nunez has been charged with 15 Felony counts, including Embezzlement and PERJURY. He has not been arrested yet. Why? also PER DA AND DEFENDANT’S ATTORNEY’S REQUEST. NTA MAY NOT REACH DEFENDANT IN TIME. NTA= Notice to appear, Mr. Nunez might not even know he has been invited to show up in court today. Very casual for a 2.5 year Criminal Investigation. How much did the 2.5 year Investigation cost SMC Taxpayer? Lets compare that to the final outcome of this case, which will most likely never get to a Jury Trial.
Just because a person is criminally charged with a crime in San Mateo County doesn’t mean that he or she is guilty. Look no further than Sheriff Deputy Juan P. Lopez case NF433910A or the Sheriff Activities League (SAL) Embezzlement and Money Laundering case.
The Public is invited to attend in person by Hon. Judge Leland Davis III. Up until November 22, 2021 the public which includes reporters were able to Listen to the Hearing by calling this number 503-300-6847 Code 438807. Remember there is a Pandemic in the world including San Mateo County.
Public Access Policy Updated 11/22/21 – The listen-only public access lines are no longer in effect; proceedings are open to the public to attend in person.
I have recommended a Single Point Data Base to San Mateo County Government (SUPERVISORS) for 20 years. Just think how much time and money it would have saved if it caught the alleged Felony on 3/4/2009. Also it would be helpful if the District Attorney’s Office charge all people equally, for example if a Judge, a court clerk, and a court reporter committed a Felony, it would go a long way for Public Trust if they were arrested, charged, and prosecuted. Here are the current charges in the Nunez case.

Upadte: This Motion to Destroy has been continued to January 3, 2022
Today December 20, 2021 at 10:00 AM in Courtroom 2A the Hon Judge Barbara Mallach will rule on a Motion to Destroy all of the records in the People vs. Zainali Jaffer case 17NF012415A. The Public is invited to attend in person.
Who filed the Motion to Destroy all records and Body Worn Camera Video?
I call this the “Magic Case” because of the “Magic Meeting” held on June 7, 2018
Who is speaking for the two Children?
Diminished Capacity is No Excuse for Criminal Conduct
This case should be taught at every law school in the United States of America. NOT Destroyed.
Zain Jaffer the other day I wrote about you assisting Sheriff Deputy Juan P. Lopez with his 7 year legal defense expenses now over $300,000, and I see that tomorrow David Khan of Daly City has a court appearance in front of Hon. Judge Barbara Mallach in Courtroom 2A at 10:00 AM just like you do. David Khan would be another person I recommend to you for your help. The other three families mentioned above have lost loved ones to Homicides by San Mateo County Law Enforcement. They could use you help against the Government in those cases.
Your prepared statement that you read when your case was Dismissed, July 2, 2018
“I was incredibly fortunate that I was able to defend myself through the legal system, but I am aware that many others are not. Moving forward, I plan on examining ways that I can help others who are innocent and are seeking to obtain justice.”
In the last 3.5 years I have not seen anyone that you have helped or even asked about for that matter.
Thank You, in advance for considering these cases. If interested I have many more cases for you.
Update: This Motion to Destroy Records has been continued to January 3, 2022
Dear Attorney General Rob Bonta,
Please don’t forget Zain Jaffer was arrested by the Hillsborough Police Department on October 15, 2017 for Attempted Murder of a child, There is Body Worn Camera Video.
Tomorrow December 20, 2021 Superior Court of California County of San Mateo in Courtroom 2A at 10:00 AM the Hon. Judge Barbara Mallach has a Motion to Destroy all the records in the Zain Jaffer case 17NF012415A.
Destroying the Records and Evidence is Not in the Public’s Interest.
These records could be very valuable to the wife and children in the future.
Diminished Capacity is No Excuse for Criminal Conduct.

The meeting was on Thursday, June 7.·
Deputy District Attorney Sharon Cho, Deputy District Attorney Sean Gallagher and I attended along with the following people from the defense team: Attorney Patrick Clancy, attorney Daniel Olmos, Dr. Eric Wexler and Dr. George Woods.·
The meeting lasted 1 and ½ hours; Ms. Cho and the defense team remained in the meeting room after Mr. Gallagher and I left. I do not know how much longer they stayed.·
Yes, we viewed the body camera footage.
From: Michael Stogner [mailto:michaelgstogner@yahoo.com] Sent: Saturday, July 28, 2018 9:02 AM To: Karen Guidotti <kguidotti@smcgov.org> Subject: Zain Jaffer case Hello Karen, What date did the defense team for Zain Jaffer make the presentation in the District Attorney’s Office? Who attended? How long was that meeting? Were HPD body camera videos looked at or discussed?
This case was Very Fast from start to finish, How and Why?
Just because somebody says something is true, doesn’t mean that it is.
As it turns out a San Mateo County Resident was arrested and Criminally Charged with three Felony Sexual Assault counts Bail was $500,000 and 47 days later his case is complete all the Sexual Assault charges are dismissed. This would be a good case for an AUDIT to simply find out what really happened. Was a man falsely charged in the first place? There is No Comment from Sheriff Carlos G. Bolanos about his Sheriff Investigators and their work on this case. What are their thoughts?
Sean Gallagher and Steve Wagstaffe offered Mr. Banister to reduce this case to 1 count a Misdemeanor, Why? and Why so fast?
San Mateo County Sheriff Office arrested Mr. Banister on August 31, 2021 after Investigating the Sexual Assault allegations. The Investigation started on August 2, 2021, A Judge issued a $500,000 Warrant for his arrest based on the SMCSO work product.
San Mateo County District Attorney’s Office filed the charges below on November 1, 2021, that’s 2 months after his arrest. So the District Attorney’s Office had two months to review the SMCSO Investigators work and they confirmed the three Felony sexual assault charges on an 11 year old victim.
On November 30, 2021 this offer was read in court, that is 29 days after the charges were approved and filed, What changed? What Happened?
I was not able to report what the District Attorney’s Offer was on November 30, 2021 because I was not sitting in the Courtroom. Also not in the Courtroom that morning was defendant Michael D. Banister and his defense attorney Joseph Goethals. They appeared by zoom or phone.
Superior Court of California, County of San Mateo Presiding Judge Leland Davis III cancelled the Public Access by Telephone on November 22, 2021. He has never explained Why? It can’t be because it’s safe to attend court in person now, So it must be some other really Important reason.
“The listen-only public access lines are no longer in effect; proceedings are open to the public to attend in person.“
The San Mateo County District Attorney’s Office has a Victim’s Advocate. Did the Victim’s Advocate meet with the child and did he/she agree with this offer?
Did the parents of the victim agree with the offer?
Does anybody wonder why Sexual Assault Victims don’t want to report the crimes.
Does San Mateo County District Attorney’s Office ever charge somebody with crimes they know they did not commit? Of course they do, look no further than People vs. Juan Pablo Lopez case NF433910A
Is that what happened is this case? I don’t know. Somebody reported a crime, the Sheriff’s Office Investigated and so did the District Attorney’s Office. They called the 11 year old girl a Victim.
How is it possible for these charges to be DISMISSED?
Remember a person is innocent until proven Guilty.
Mr. Jaffer said he appreciates that justice was served in his case and that he wants to help other people who find themselves in similar situations. “I was incredibly fortunate that I was able to defend myself through the legal system, but I am aware that many others are not. Moving forward, I plan on examining ways that I can help others who are innocent and are seeking to obtain justice.”
Mr. Jaffer I had hoped to see you sooner, that has not happened yet, let me bring the People vs. Juan Pablo Lopez case NF433910A to your attention, I think this case is exactly what you were talking about when you made your statement in a Superior Court of California County of San Mateo.
Just to refresh your memory, San Mateo County Sheriff Deputy Juan P. Lopez was arrested 7 years ago at gun point at one of his homes in front of his son. He was falsely charged with Smuggling a Cellphone and Drugs to a Hells Angel Gang Member who was an inmate in the Redwood City Jail, so both of you know what the inside of that jail looks like.
The Sheriff Deputy Juan P. Lopez case is the perfect example of Organized Crime and Corruption that I have witnessed in the last 20 years. As you can imagine the personal humiliation of being arrested twice, falsely charged, the cost for Attorneys for 7 years, and the loss of Income for 7 years.
Most recently Hon. Judge Joseph Scott, Court Clerk Kimberly Bihl and Court Reporter Jocelyne Fakhouri conspired to commit a crime and then did. PC115(a)
Also most recently Superior Court of California, County of San Mateo Presiding Judge Leland Davis III issued a policy change for Public Access by Telephone.
Public Access Policy Updated 11/22/21 – The listen-only public access lines are no longer in effect; proceedings are open to the public to attend in person.
This policy change is most likely connected to the Juan P. Lopez criminal case and the RECORDING from July 27, 2021 which PROVES a Judge, a Court Clerk, and Court Reporter committed a Felony.
Mr. Jaffer, I know you are busy, Thank You, for considering this as one of your cases to help.
Public Access Policy Updated 11/22/21 – The listen-only public access lines are no longer in effect; proceedings are open to the public to attend in person.

Dear Mr. Stogner,
The court received the (attached) request, which you submitted pursuant to rule 10.500 of the California Rules of Court, on Tuesday, December 7, 2021.
The court has concluded that processing this request will require additional time and, therefore, is invoking the 14-day extension permitted under rule 10.500. (See Cal. Rules of Court, rule 10.500(e)(8)(A)–(C).) We estimate we will be able to notify you whether the court has disclosable responsive records by Monday, January 10, 2022.

It’s no Secret that the San Mateo Daily Journal and District Attorney Steve Wagstaffe want Sheriff Carlos G. Bolanos to be Re-Elected in the next election.
SMDJ knows this is not quiet the truth, Bolanos — appointed in 2016, Somebody removed this News Release from the Governments website before the July 12, 2016 Board of Supervisor Meeting, John Maltbie was the Clerk to the Supervisors and John Beiers San Mateo County Counsel would have word crafted and final approval of the agenda item. Who removed Michelle Durand’s press release, and Who word crafted the agenda Item. Remember Don Horsley and Carole Groom were asked to RECUSE themselves. They didn’t.
Bolanos — appointed in 2016, elected in 2018 and now running for reelection — said he also routinely receives outlandish emails and communications from people which he said he’s learned to ignore.
Now vindicated, Bolanos said he’s thankful the DA’s office investigated the case and hopes the public will be less inclined to believe such allegations in the future.
“I’m glad the District Attorney’s Office investigated it and determined that there was absolutely no merit to me being involved with that organization,” Bolanos said. “Hopefully people learn from this and recognize that just because somebody says something and tweets something it may not be true. People should do some critical thinking before they assume something.”
This sounded familiar,
“just because somebody says something and tweets something it may not be true.“
I’ve been saying this for just over 20 years, “Just because somebody says something is true, doesn’t mean that it is.” I can’t take credit for the statement I first heard it in court by a very popular San Carlos Attorney named Jeff Cost. He credited it to his father.
The SMDJ in 2018 Endorsed Carlos G. Bolanos for Sheriff which is fine, but they also printed a False statement about Him being “OUTSIDE the entire time.” Operation Dollhouse, FBI Sting Las Vegas Nevada, April 21, 2007.
Everybody and their Mother knows that is a Lie.
Here is the entire SMDJ article from December 15, 2021
San Mateo County District Attorney’s Office solves mystery over Oath Keeper account Belmont resident responsible for creating memberships for sheriff, police chief to far-right group By Sierra Lopez Daily Journal staff 3 hrs ago Carlos Bolanos A Belmont resident was responsible for registering Sheriff Carlos Bolanos and former Belmont Police Chief Dan DeSmidt with a far-right anti-government organization as a reminder of their oath to the Constitution, an investigation by the San Mateo County District Attorney’s Office found.“ Anybody who knows me knows I’m not of the persuasion that would join an organization like that. They knew it was a joke but unfortunately, it got taken seriously and it wasn’t funny anymore,” Bolanos said. In October, allegations that Bolanos was affiliated with the Oath Keepers, a national right-wing militia group, were first made online after his email was discovered in a leaked database published and stored by the anti-secrecy organization Distribution Denial of Secrets. At the time, Bolanos denied being a member of the organization and asserted that someone else must have registered him, though he was unsure of who would have done so. Bolanos said a news organization discovered that a third party likely registered him with the organization and he immediately turned that information over to the DA’s office.Additional information was also shared with the office from the San Mateo County Counsel’s Office, Bill Massey, chief investigator with the DA’s office, said. The department did not go through the leaked database but Massey said they did reach out to the Oath Keepers, which was unresponsive. What their investigation did find was that a Belmont resident registered Bolanos and DeSmidt with the organization in 2017. The Belmont Police Department was also made aware of the incident back in 2017, but declined to pursue the case at the time because they were familiar with the individual’s behavior, Massey said.“Without going into detail, he’s a very outspoken individual. He has some views that may not be mainstream so he’s known in the city of Belmont,” Massey said about the person who created the accounts for the officials. When questioned, Massey said the individual confessed to registering the public officials with the organization with the intent of reminding them of their oath to the U.S. Constitution. Massey said they verified the individual was responsible for the accounts by reviewing packages from the Oath Keepers which were addressed to Bolanos and DeSmidt but sent to the Belmont resident’s home.Massey said the DA’s office was investigating the issue of impersonation and identity theft of Bolanos given that the Sheriff’s Office couldn’t investigate a case in which the sheriff is the victim. Under Penal Code 528.5, the individual could have been charged with a misdemeanor for impersonating an individual online without permission with the intent of harming, intimidating, threatening or defrauding another person. But the DA’s office opted to not file charges because they could not verify that the individual’s actions were done maliciously. Additionally, the investigation fell outside a one-year statute of limitation embedded in the penal code because the Belmont Police Department was aware of the issue around 2017, triggering the statute countdown.Bolanos — appointed in 2016, elected in 2018 and now running for reelection — said he also routinely receives outlandish emails and communications from people which he said he’s learned to ignore. Now vindicated, Bolanos said he’s thankful the DA’s office investigated the case and hopes the public will be less inclined to believe such allegations in the future.“I’m glad the District Attorney’s Office investigated it and determined that there was absolutely no merit to me being involved with that organization,” Bolanos said. “Hopefully people learn from this and recognize that just because somebody says something and tweets something it may not be true. People should do some critical thinking before they assume something.”sierra@smdailyjournal.com(650) 344-5200 ext. 106
Here is a simple question for Reporter Sierra Lopez, What is the name of the Belmont Resident?
Pretty cool to Solve a Mystery with an Unnamed and Uncharged Belmont Resident.
