If Hon. Judge Joseph Scotts’ court clerk Katrina Bihl had not name dropped this case on a Open Public Access phone line that was left on instead of being muted as she declared under the penalty of Perjury to the court, I would have not heard about it. I was on that Public Access Phone Line July 27, 2021 for the Sheriff Deputy Juan P. Lopez motion to continue that only lasted a few minutes. San Mateo County District Attorney Inspector Jordan Boyd got a copy of the phone records for that morning, it shows my phone number on that call 2 different times. Inspector Jordan Boyd never called me to ask what did I hear on that open phone line that morning? He has never bothered to ask me anything when we are both in the same courtroom for the Juan P. Lopez Criminal Case? The last time we were in the same courtroom was last Friday in Courtroom 2G 9:00AM.
To the residents of San Mateo County you might remember your District Attorney’s Office Deliberately Filed FALSE charges against San Mateo County Sheriff Deputy Juan Pablo Lopez in 2014. That was close to 8 years ago. They arrested him at gunpoint in front of his son. They held a Press Conference the charges included Smuggling a cell phone and drugs into the Maguire Jail and delivering them to an inmate. Every San Mateo County Employee involved with that investigation knew the Charges were FALSE.
Why was Sheriff Deputy Juan P. Lopez falsely charged? Why is that OK with the 5 Supervisors.
Why is that OK with the 760,000 San Mateo County residents?
Why is that OK with Fixin SMC?
Why is that OK with Sheriff Elect Christina Corpus?
Why is that OK with the 800 Sheriff Employees?
Recently there was an Letter to the Editor titled Judges for Sheriff Bolanos. I laughed when I read that and thought that would be a great name for the Sheriff Deputy Juan P. Lopez criminal case.
As many of you know San Mateo County News.com has been reporting on Deputy Lopez’s case from the very beginning. I have attended almost every single hearing for more than 5 years I have lived in Monterey County so you can do the math on how many hours I have spent in Gridlock and court to bring the NEWS about this Very Important Criminal Case which demonstrates the Organized Crime and Corruption at all levels of San Mateo County Government.

I think everyone knows by now that Sheriff Carlos G. Bolanos lost the election this month. I was surprised that he ran at all. For those of you who didn’t know Sheriff Carlos G. Bolanos has been on the Witness list in the Juan P. Lopez case for almost 8 years, He has been protected by the County Counsel Attorneys all this this. Come January he is Retiring and it will be interesting to see if the Taxpayers continue to provide free legal services to him.
Enforcing the Law Equally has Never been a Strong Suit for D.A. Steve Wagstaffe or Sheriff Carlos G. Bolanos. Don’t forget San Mateo Residents were all notified with the April 25, 2007 E-mails.

On page 2 Line 13 Katrina Bihl Declares under the Penalty of Perjury the following: After the hearing, as was my usual practice, I muted the public access line and proceeded to work at my desk in the courtroom while I waited to see if the master calendar court would send any matters to this courtroom.
That statement is simply false.
SMCDA Inspector Jordon Boyd could have simply called me. He Never did.
The filing of this declaration with the court is a PC115(a) a Felony.
San Mateo County District Attorney Office Inspector Jordan Boyd knows that is a False Statement. So does DDA Kimberly Perrotti and yet they continue to march on to cause as much pain and suffering on a San Mateo County Sheriff Deputy now retired.

Yesterday was a first for me in 22 years observing and reporting of SMC Courts. San Mateo County District Attorney Deputy Kimberly Perrotti informed the court that she had personally contacted the Santa Clara County District Attorney’s prosecutor who was trying a case that Sheriff Deputy Juan P. Lopez’s Co-Counsel Erica Elizabeth Treeby was the defense attorney in. She reported to Judge Scott that Ms. Treeby would be available on March 17, 2022 in SMC, because of this alleged conversation. She did not identify this person, and this person has not been called to testify about this alleged conversation and there was no declaration filed.
I think it would be great for the public to know about that entire conversation from start to finish.
I would like to know how many times DDA Kimberly Perrotti has checked up on the Defense Attorneys opposing her?

Former San Mateo County Sheriff Deputy Juan P. Lopez is in court today January 12, 2022 at 9:30 A.M. in Courtroom 2G. The Judge hearing the Motion is Hon. Judge Joseph Scott.
You will recall that Defense Attorney Tony Serra respectfully asked Judge Scott to recuse himself for Bias. He hired a law firm in Riverside and declined.
San Mateo County Counsel Attorney Joseph Charles is representing SMC District Attorney Steve Wagstaffe who has been doing everything possible to not have to Testify under–oath in this case.
The six charges that are in court today over 7 years after District Attorney Steve Wafstaffe gave a News Press Release in front of Television crew to announce that Sheriff Deputy Juan P. Lopez was Arrested and Charged with Smuggling a Cellphone and Drugs into the Maguire Jail and gave them to a Hells Angel Gang Member. That NEVER Happened.
On that day standing in front of those News cameras, District Attorney Steve Wagstaffe, William Massey, John Warren, Jordan Boyd, Sheriff Carlos G. Bolanos, Sgt. Jason Peardon, Lt. Andrew Armando, San Mateo County Counsel all knew or should have known those charges were 100% FALSE.
Now today in court the remaining 6 charges and the ONLY charges that DDA Kimberly Perrotti want the jury to hear or know about is Mortgage, Insurance and Election Fraud.
Did Sheriff Deputy Juan P. Lopez vote from Both of his residences? Nope only Redwood City, where his car was broken into. That is where Jordan Boyd knew he lived.
Remember in 2014 Sheriff Deputy Juan Pablo Lopez reported to the San Mateo County Sheriff Office that his car was broken into in the garage area of his Redwood City Condo. When he was asked by the Deputy who took the report, do you have any idea who might have done this?

This is a “Those who Matter” case, San Mateo County Sheriff Carlos G. Bolanos provided NO BOOKING PHOTO or PRESS/NEWS RELEASE of the arrest. Why?
That is the first Tell. The 2nd Tell is Defense Attorney Josh Bentley, The 3rd Tell District Attorney Steve Wagstaffe filed this case as a Misdemeanor 21-SM instead of a 21-SF which is a FELONY.

By declining a sobriety test at the scene, you forfeit California Drivers License for 1 year, unless you are one of the “Those Who Matter” TEAM.

San Mateo County has a First Chance DUI program for 1st time offenders. To my knowledge it does not have a 4th or 5th Chance DUI Program.

When I say watch this case, I mean show up to Court IN PERSON. A reasonable thinking person would know that there is a COVID-19 Pandemic in San Mateo County at this time. Most residents in San Mateo County don’t know that the behavior of the Police Department is the responsibility of the City Manager. The voters of Daly City can not recall the City Manager, The City Council can Fire/Terminate her if they wish too, they don’t. So the only option is to RECALL the Councilmembers.
You may remember the Residents of Foster City, San Mateo County, California recently Successfully RECALLED Herb Perez the vice mayor. You can just imagine how many Political Experts thought that was terrible Idea.
There are many families in San Mateo County who have lost loved ones to Homicide by Law Enforcement. Please keep them in your thoughts.

SMCCCD Vice Chancellor Jose D. Nunez has been charged with 15 Felony counts, including Embezzlement and PERJURY. He has not been arrested yet. Why? also PER DA AND DEFENDANT’S ATTORNEY’S REQUEST. NTA MAY NOT REACH DEFENDANT IN TIME. NTA= Notice to appear, Mr. Nunez might not even know he has been invited to show up in court today. Very casual for a 2.5 year Criminal Investigation. How much did the 2.5 year Investigation cost SMC Taxpayer? Lets compare that to the final outcome of this case, which will most likely never get to a Jury Trial.
Just because a person is criminally charged with a crime in San Mateo County doesn’t mean that he or she is guilty. Look no further than Sheriff Deputy Juan P. Lopez case NF433910A or the Sheriff Activities League (SAL) Embezzlement and Money Laundering case.

I have recommended a Single Point Data Base to San Mateo County Government (SUPERVISORS) for 20 years. Just think how much time and money it would have saved if it caught the alleged Felony on 3/4/2009. Also it would be helpful if the District Attorney’s Office charge all people equally, for example if a Judge, a court clerk, and a court reporter committed a Felony, it would go a long way for Public Trust if they were arrested, charged, and prosecuted. This case was Very Fast from start to finish, How and Why?
Just because somebody says something is true, doesn’t mean that it is.
As it turns out a San Mateo County Resident was arrested and Criminally Charged with three Felony Sexual Assault counts Bail was $500,000 and 47 days later his case is complete all the Sexual Assault charges are dismissed. This would be a good case for an AUDIT to simply find out what really happened. Was a man falsely charged in the first place? There is No Comment from Sheriff Carlos G. Bolanos about his Sheriff Investigators and their work on this case. What are their thoughts?
Sean Gallagher and Steve Wagstaffe offered Mr. Banister to reduce this case to 1 count a Misdemeanor, Why? and Why so fast?
San Mateo County Sheriff Office arrested Mr. Banister on August 31, 2021 after Investigating the Sexual Assault allegations. The Investigation started on August 2, 2021, A Judge issued a $500,000 Warrant for his arrest based on the SMCSO work product.
San Mateo County District Attorney’s Office filed the charges below on November 1, 2021, that’s 2 months after his arrest. So the District Attorney’s Office had two months to review the SMCSO Investigators work and they confirmed the three Felony sexual assault charges on an 11 year old victim.
On November 30, 2021 this offer was read in court, that is 29 days after the charges were approved and filed, What changed? What Happened?
I was not able to report what the District Attorney’s Offer was on November 30, 2021 because I was not sitting in the Courtroom. Also not in the Courtroom that morning was defendant Michael D. Banister and his defense attorney Joseph Goethals. They appeared by zoom or phone.
Superior Court of California, County of San Mateo Presiding Judge Leland Davis III cancelled the Public Access by Telephone on November 22, 2021. He has never explained Why? It can’t be because it’s safe to attend court in person now, So it must be some other really Important reason.

The San Mateo County District Attorney’s Office has a Victim’s Advocate. Did the Victim’s Advocate meet with the child and did he/she agree with this offer?

Does anybody wonder why Sexual Assault Victims don’t want to report the crimes.
Does San Mateo County District Attorney’s Office ever charge somebody with crimes they know they did not commit? Of course they do, look no further than People vs. Juan Pablo Lopez case NF433910A
Is that what happened is this case? I don’t know. Somebody reported a crime, the Sheriff’s Office Investigated and so did the District Attorney’s Office. They called the 11 year old girl a Victim.
How is it possible for these charges to be DISMISSED?
Remember a person is innocent until proven Guilty.
