Daly City Manager Shawanna Maltbie, should have been Fired by City Councilmembers April 7, 2021.

Daly City Manager Shawanna Maltbie

It would have taken only 3 Daly City Councimembers to Fire her after the Roger Allen Homicide by her Police Department on April 7, 2021. The City of Foster City just demonstrated on August 25, 2021 that they don’t even need a reason to fire the City Manager, Either does the City of Daly City. What this means is that all 5 Councilmembers Support Shawanna Maltbie completely. The Official Position from the Daly City Government was Silence and Lies, Claiming 4 DC Police Officers arrived and surrounded a disabled vehicle for the sole purpose “We are here to help” Roger Allen a Black Man was dead a few minutes later.

Public Comments should always be at the beginning of a Public Meeting, Everybody knows that. There is only one reason to have it be at the end, that is to show the public who’s boss, Not Them.

Good morning All,

My Associate, The Public has asked me to compose this email. He would like to have ALL of You understand from Our point of view the situation that has transpired in Daly City.
The death of Mr. Allen was brought to The Public’s attention months ago. It has been extremely heartbreaking for All in the Community as the DCPD initiated contact with Mr. Allen, The attached letter will better explain our viewpoint on this. However painful and disturbing it is, I believe We all should review the timeline.
1, In December 2020, an Auditor did a First Amendment audit that failed due to four Daly City Police Officers (including a Sargent) not knowing the Law. The demeanor of Officer Perez, Star 27, speaks volumes of the lack of training the Daly City Police Department mandates. There is no way any member of the Community should encounter this behavior and lack of knowledge, leadership and listening skills of Sargent Hussein. These Officers need to be discharged immediately. We know that the Auditor gave an fair review as the Auditor commended the Officer and wished him a Merry Christmas at the counter. This Officer was the one who furnished with the complaint forms.
2. On April 7, 2021, Mr. Roger Allen was shot and killed by the Daly City Police Department. Again, if the Daly City Police did not initiate contact with Mr. Allen, he would be alive today.
3. The April 12, 2021 Council Meeting young adults shared their sadness and outrage. Absolutely heart wrenching for us to hear, as some of us have children their age.
4. Many email correspondences sent to Daly City Council and the Daly City Manager have gone unanswered. These questions posed are questions from The Community and The Public which City Officials need to address.
5. The September 13th, 2021, Council Meeting scheduled to commence at 6:45 pm. It began a half hour late at 7:15 pm.
6. At the September 13th 2021, the Mayor and Vice Mayor accused Council Member, DiGiovanni of racism. Council Member DiGiovanni was highly offended and from what We witnessed began crying. If Council Member DiGiovanni had not taken offense to what she considered an racist insult because the color of her skin, We not bring this matter up.
7. At the September 13th, 2021, Council Member Sylvester, mentioned that he does not want to hear someone(s) bring up a white woman’s skin color as well as other comments.
8. At the September 13th, 2021 The Public spoke up about this unacceptable, racist behavior.
9. At the September 13th, 2021, an issue arose about a possible Conflict of Interest with the Mayors name appearing on a fundraiser or other event. A complaint will be or has been filed with Agency that oversees such matters.
10. At the September 13th, 2021, The Public demanded the resignation of ALL Daly City Officials.
11. In September 2021, a Community Member visited City Hall in Daly City to communicate with City Officials. The doors to the departments were closed and locked. Subsequent email correspondence has been sent to Daly City Officials to communicate and no response has been received back.
12, The calendar invitation that the Community and Public received for the September 27th, 2021, states the Meeting was to commence at 6:45 pm. The Meeting began at 7:02 pm. Once more late and wasting The Public and Community’s time.
13. At the September 27th, 2021 Council Meeting, Council Member Sylvester mentioned a Comment made by The Public at the previous September 13th, 2021 Council Meeting. Council Member Sylvester mentioned the comment was made in anonymity. The Supreme Court has ruled that a Member of The Public can do so. The First Amendment of the U.S. Constitution allows The Public to do so. This clearly shows a lack of the Law by Council Member Sylvester. The U.S. Constitution allows many rights of The People not to identify themselves even with Peace Officers. This is why one of the reasons the Daly City Police Department are in a state of crisis.
14, The Daly City Police Chief(s) both acting and non acting (Officers Gamez and Hensley) have received email requests to meet with the Community and The Public. No response has received as if yet.
Having worked in the private sector, these behaviors and lack of responses would not be tolerated.Immediate terminations would be swift. Changes must be made for the happiness, safety, security and Greater Good of The Daly City Community. (see attached document).

On a personal note, no one should ever live in fear. We are appealing to ALL of you to make the right choices and changes.
Please let us know when any Daly City Official(s) can meet regarding a transition to make the changes.

Message to Shawanna Maltbie and all Elected Officials in Daly City.

This morning I couldn’t help thinking about Roger Allen R.I.P. As we all know now he was killed by 4 Daly City Police Officers while sitting in a disabled vehicle. The Official story was the Police Officers were there to Help/Assist.

This morning I found myself in a disabled vehicle, blocking one of two lanes of traffic in Salinas, California. I called AAA and as I was on the phone, a Monterey Sheriff Patrol car pulled up behind me with his light bar lit up, a short time later a 2nd Sheriff Patrol car arrived and parked behind the first car. They asked me if I had called for a Tow and I said yes, they asked if I knew how long before the Tow Truck would arrive? I said I don’t know yet. I asked the first officer if he could push my car through the intersection and he explained that his push bars might damage my rear bumper and it was no problem, he would just stay until the Tow Truck arrived.

The two Monterey Sheriff Deputies stayed with me and my disabled vehicle for 40 Minutes until the Tow Truck arrived and loaded me and my vehicle. They never once asked me my name, they never approached and surrounded my vehicle, they never once said “We are here to Help” They simply made sure I was safe and my vehicle did not get run into by a distracted driver.

Thank You, Monterey County Sheriff Office Deputies, for your professional behavior this morning. I only wish Roger Allen R.I.P. had you to protect him.

Background April 7, 2021 Roger Allen was shot and killed by Daly City Police Department, he was sitting in the passenger seat of a disabled truck. Nobody requested the Police to show up. 4 Officers did and surrounded the vehicle. The Official report from Chief of Police Patrick Hensley and approved by Shawanna Maltbie was “They were there to Help.” That was the first time I had heard of Daly City Police Officers “We are here to Help” on what normally would be a AAA call to fix a flat tire.

Shawanna Maltbie the City Manager is responsible for the behavior of the Police Department, (What I mean by that is the City Manager can Fire the Police Chief and she could have named the 4 Officers the very first day of the Homicide, She simply chose not to.) and serves at the pleasure of the City Council. This was just demonstrated to all SMC Residents by the Foster City Gang of 3 (G3) when they FIRED Dr. Peter Prinejad, August 25, 2021, their recently hired City Manager for NO CAUSE.

Daly City has NO Councilmember at this time who thinks Shawanna Maltbie should be fired. That is why Public is now speaking up. The Public is responsible for how their Government acts.

Per the The Public’s demands from The Daly City Council Meeting from this past Monday, September 13, 2021, The Daly City Public will be visiting Daly City Hall, Today, September 20th, around 11:30 AM to confirm resignation of all Daly City Council Members, City Manager, Assistant City Manager, City Clerk and Police Chief.
These demands were made at the 2:41:49 mark.

Foster City, Who’s Flying the Plane?

It wasn’t that long ago that a group of Foster City residents got together and said Enough is Enough. They organized, collected signatures, put a Recall measure on the ballot, and removed the Vice Mayor, from office, and they were SUCCESSFUL Why? Lack of Decency, that’s why. They wanted their Elected Officials to behave in a respectful and decent manner at all times, especially towards members of the public.

The residents of Foster City have demonstrated before their demand for Honesty and Decency.

This story is at the very beginning it is about San Mateo County Politics and Those Who Matter vs. the Residents.

What was so important to remove the Recently Hired City Manager at this moment in time when the Assistant City Manager had just left Foster City 2 weeks ago, and has not been replaced. That equals a Leadership vacuum that was self inflicted by Hindi, Awasthi, and Sullivan. They have caused their City to be missing the two Full time employees who run the City.

Surely they must have a plan that they just haven’t shared yet, and the public looks forward to learning about it.

Imagine being on a 747 flight from SFO to Hawaii and you’ve just been informed that your Pilot and Co-Pilot are No Longer Flying the plane.

San Mateo County Elected Officials and Staff. What world are you living in?

Daly City has requested A.G. to investigate the Homicide by Law Enforcement of Roger Allen.

This is a good step.

 “We are taking these important steps to provide the community with the most independent, impartial and
transparent investigations possible,” said Mayor Juslyn C. Manalo in a news release. “Building and maintaining trust is a foundational priority, and the City Council and I take this responsibility very seriously.”

At the request of the City Council, City Attorney Rose Zimmerman sent a letter to Bonta on Friday requesting that his office begin a parallel investigation of the incident.

To this day nobody knows who shot and killed Roger Allen on April 7, 2021.

City of Daly City Manager Shawnna Maltbie has kept a tight lid on any and all information regarding the April 7, 2021 Homicide of Roger Allen R.I.P. by somebody from her Police Department. Here is what we know for sure Roger Allen is dead, that’s about it. We don’t know who shot him or why 4 DCPD Officers were at a disabled truck with a flat time in the first place.

Who’s gun fired shots? See how simple this is? An examination of the officer’s gun showed that a single round was fired.

Why would Daly City Elected Officials and Staff go the opposite way of America in 2021. I would guess it’s simple Math. They are betting this will settle with a payment of Taxpayer money and Never get to a Jury trial. That way a NDA will be signed and No more information will be made public then we know today.

Public comment about any subject should be at the beginning of city council meetings. Then, public comment for each agendized item. Daly City not having body and dash cameras, their lack of transparency regarding a police homicide and making residents wait several hours for public comment are done intentionally to thwart democracy and the rights of the citizens who pay the salaries of city staff, and police department personnel. Where is the council oversight? Why do voters put up with this? You can’t recall a city manager, but you can recall a city council.

Just north of Daly City, San Francisco Police shot a man on May 7, 2021, He wasn’t killed but here is what happened the Police Chief Identified the Officer who shot him and he Apologized to the public.

San Francisco Police Chief William “Bill” Scott has offered a rare public apology for an officer’s recent shooting of an unarmed car burglary suspect.
Xavier Pittman Jr., 23, was shot in the wrist by plainclothes Officer Zachary McAuliffe as he was being arrested May 7. Pittman is a suspect in a series of car burglaries.
He was treated at a hospital for injuries that were not life-threatening, officials said. An examination of the officer’s gun showed that a single round was fired.
“The shooting of Mr. Pittman quite simply should not have happened,” Scott said during an online town hall on Thursday. “I’m deeply sorry that Mr. Pittman was shot during this incident, and I would like to take this opportunity to publicly apologize to Mr. Pittman, his family and his friends.”
Scott added a wider public apology, saying, “We know you expect us to get this right, and we know how traumatic it is to see these types of incidents — especially when they should not have happened.”
The chief said the shooting remains under investigation. He said plainclothes officers are exempt from wearing body cameras, but that video surveillance from a nearby business recorded the shooting.
The incident began when police received 911 calls that several suspects in a silver Mitsubishi Eclipse Cross were breaking into vehicles all over the city, from Golden Gate Park to Fisherman’s Wharf.
Shortly after noon, U.S. Park Police spotted the Mitsubishi in the Presidio area of San Francisco and tried to stop it, but the vehicle sped away.
McAuliffe and a colleague found the vehicle and the suspects at Jack London Alley and Varney Place, police said. As some suspects fled in the Mitsubishi, the officers apprehended Pittman and the shot was fired.

“Plainclothes officer No. 1 grabbed Mr. Pittman, and both fell to the ground,” a San Francisco police commander said during the town hall.
In the scuffle, he said, the officer’s handgun fired and struck Pittman “in the left wrist area.”
According to the video, one officer can be heard yelling: “Police Department! Police!” Immediately afterward, a gunshot is heard.
Pittman, who was unarmed, is heard saying he has been shot and requests an ambulance.
McAuliffe “did not intend for his firearm to go off,” his attorney Mike Hinckley said. “He sincerely apologizes to Mr. Pitman and wishes him a full speedy recovery.”
Pittman’s attorney, Adante Pointer, said it is “unclear whether it was an accidental discharge or intentional, as the video is not terribly clear.”
He said his client did not do anything to warrant deadly force being used against him. He said the officer was acting recklessly.
“For safety reasons, officers are trained not to have their gun in hand when they go hands on with a person in order to prevent this very thing or something worse from happening,” he said. “This could have easily been a fatal shooting of my client or of another person in the vicinity.”
The Police Department has yet to determine whether the gunshot was intended. The San Francisco district attorney will decide whether the officer involved will face criminal charges.
Pittman was arrested on suspicion of second-degree car burglary, conspiracy, possession of stolen property and committing a felony while on release.
Police said the other suspects remain at large. The Mitsubishi was found abandoned in Oakland. Investigators also recovered a large amount of stolen property from the auto burglaries.

NEWS RELEASE Incident Date and Time: April 30, 2021 @ 2:26 pm

Location: 500 block of Quarry Road, San Carlos Summary: Deputies Added ECIT Resources and Training has Positive Outcome in

Disengagement of Person in Crisis During Welfare Check.

On Friday, April 30, 2021, San Mateo County Sheriff’s Deputies responded to the 500 block of Quarry Road in San Carlos to conduct a welfare check on an individual who was reported as possibly experiencing a mental health crisis. While enroute, deputies learned the subject was also in possession of a knife. Deputies staged a safe distance away and made phone contact with several parties at the scene, including the individual’s social worker.

Deputies learned the individual did not make any threats, commit any crimes, and no one was being held against their will. The individual had no interest in speaking with his social worker
in person or with deputies on the phone. Approximately one hour after arriving on scene, deputies determined it was in everyone’s best interest that they disengage and leave the scene without forcing contact with the individual. Deputies followed-up with the individuals social worker the following day and learned the individual had stabilized and was no longer experiencing a mental health crisis.

This response highlights the San Mateo County Sheriff’s Office’s Enhanced Crisis Intervention Training program (ECIT) and how our crisis response has aligned with recent law changes (California AB-392) as well as community expectations. Unless there is imminent danger or threats to others, deputies will conduct pre-assessments, gather as much information as possible, and form a plan for de-escalation prior to attempting contact with individual in crisis.

We understand the mere presence of uniformed deputies can escalate situations, and we will utilize time and distance whenever possible to assess the best course of action for each situation. In cases like this, by modifying our response and not making immediate contact to check the welfare of an individual in crisis, we maintain the option to disengage, which in some cases, provides the individual the opportunity to self-de-escalate.

In many cases where mental illness is involved, crisis communication and verbal de-escalation can prove to be challenging because their disability may affect their ability to understand or comply with commands from deputies. For this reason, disengagement in these cases is sometimes the best de- escalation option. Deputies can then refer the case to the Sheriff’s Office Psychiatric Emergency Response Team, who will then form a plan to contact the subject at a later time if appropriate, to assess for resources.

Daly City Manager Shawnna Maltbie

The City Manager is responsible for the Police Departments behavior. She is also responsible for the Agenda Items on council meetings and when Public Comment takes place during the meetings etc. Most cities in San Mateo County have the Public Comment at the beginning of the meeting and the time allowed to speak is in some cities is 3 minutes. There is a Zoom link for the meeting and that is published on the City Website for everyone interested to use. At the time of the meeting the Concerned Citizens simply go to that Zoom link and they are in the meeting.

Shawnna Maltbie likes to have a little more control on the Concerned Citizens speaking their minds. She makes them register in advance for a Public Meeting including giving your home address? That’s got to give most people that welcoming feeling, that Government really wants to listen to you. Also she likes the Public Comment to be at the END of the council meetings, that really helps in having fewer comments to have to listen to. Council meetings last for hours. April 26, 2021 for example had over 130 Concerned Citizens who pre registered to speak about Roger Allen’s Homicide.

Government (I mean Shawnna) does not like the public to criticize how things are going or to ask the obvious questions. Like why 4 Daly City Police Officers were at a disabled truck with a flat tire in the first place.

“Hello we are the Daly City Police Department we are here to assist you.”

When did DCPD start competing with AAA?

Shawnna Maltbie has refused to inform the public, Who was the first Officer on the scene?

Who was the Officer that allegedly reached into a vehicle and wrestle with Roger Allen R.I.P.?

How many shots do you say were fired?

Who did you communicate with to determine your actions to withhold all of the Transparency in this Homicide?

Was it your husband Jeff Maltbie City Manager of San Carlos? Was it your Father in Law John Maltbie former San Mateo County Manager? Your sister in law Jayme Ackemann (Maltbie)?

Daly City Government is a perfect example of the Maltbie Family 101 How to run SMC Government.

It has been 34 days since Roger Allen R.I.P. was shot and killed in the passenger seat of a disabled truck in the afternoon in Daly City.

That is all San Mateo County Residents know to this day, we do know the names of the four Officers involved, Big deal.

What was SMC Sheriff Deputy David Dominguez’s Discipline?

What did Half Moon Bay City Manager Bob Nesbit and Deputy City Manager Matthew Chidester and SMCSO Chief Saul Lopez do to make sure the Official Government Statement from Sheriff Carlos G. Bolanos his Public Information Officer Rosemary Blankswade, Lieutenant Stephanie Josephson and District Attorney Steve Wagstaffe “Sheriff Deputy David Dominguez did Not turn on his Body Worn Camera,” was in fact a TRUE Statement?

The sad answer is very little. The question is Why? Why aren’t they as interested as Concerned Citizens?

It’s really SIMPLE, the AXON LOG RECORDS will verify the Government’s official statement. Who is obstructing the release of the AXON LOG RECORDS? Answer San Mateo County Counsel Attorney David Silberman. Why?

No mention of the Policy BWC Violation, The Governments claim that the Body Worn Camera was not turned on.

“Harmon fired at the first deputy on the scene.” What evidence is there to verify this statement?

Below the Video created by Sheriff Carlos G. Bolanos that was made public 41 days after the Homicide of Sandra Lee Harmon this False statement is made, The incident involved a woman, armed with a shotgun, who fired at a deputy. When did she fire? Where was she when this occurred? How many shots did she fire?

There is no mention of the Three Fatal Shots into Sandra’s back, the fact that she was shot at while unarmed and hands were above her head while her back was facing Deputy Dominguez, or the fact that Three shell casings were moved to support the governments official story.

A reasonable person would know that those are important facts the public should have been told by Sheriff Bolanos.

“Our goal in releasing these videos, while still early in the investigation, is to provide our community with as much information as possible when we have a tragic incident such as this,” Bolanos said.

Is that a true/honest statement? Remember the Video was released 41 days after Sandra L. Harmon was killed.
