City of Half Moon Bay Public Safety Subcommittee Meeting June 24th.

This is the City response after tabling the Jimenez-Rarback Report last week. Three of the council members want more discussion from the public, more listening sessions. They don’t think 7 years since Yanira Serrano Garcia’s Homicide by a sole San Mateo County Sheriff Deputy with No Plan on how to handle the Non Emergency Medical 911 call by her brother Tony Serrano is enough to take corrective action. Of course it is.

The Jimenez-Harback Report called for the creation of a Chief of Police for Half Moon Bay. A position with authority that answers to the City council. That seems like a strange request since Half Moon Bay has Sheriff Captain Saul Lopez who has attended many recent Zoom meetings he is identified as the Chief of Police of Services.

Joaquin Jimenez and Harvey Rarback have discovered what many in San Mateo County Government have known for a long time. The city has absolutely No say in how Sherif Carlos G. Bolanos provides Law Enforcement/Public Safety Services.

The Sandra Lee Harmon Homicide May 5, 2020 is a perfect example. Sheriff Bolanos told the world there was a Shootout and Ms. Harmon fired first at Deputy Dominguez. Of course if that Official Statement were true nobody would blame Deputy Dominguez for returning fire causing the death of Ms. Harmon. He told his Sergeant he fired 5-6 rounds. He actually fired 11 rounds, He failed to mention he fired at her first, and also while she was unarmed with her hands above her head and her back towards him. Ms. Harmon was shot three times in the back all Fatal. He also failed to mention he did not turn on his Body Worn Camera.

The AXON LOG RECORDS keep a precise record of all devices involved in a Critical Incident, example when they were turned on/off.

Sheriff Carlos G. Bolanos and San Mateo County Counsel Attorney David Silberman are the lead opposition for making the AXON LOG RECORDS Public.

Those Records would prove the Government’s Official Statement to be true, Why won’t they release them?

The City of Half Moon Bay has requested those records and have been denied.

The Public Safety Subcommittee Meeting is set for June 24, 2021 5:00 P.M. at the Library

I recommend Half Moon Bay Invite Hon. Judge Lisa Novak, Rachel A. Quintana and Retired San Mateo County Sheriff Sergeant Michael Otte to attend a future meeting.

HMB Council Meeting June 15, 2021, The Jimenez-Rarback Report Item 3A.

RECOMMENDATION:

Receive a presentation on the report from Councilmembers Jimenez and Rarback, receive public comment, discuss the report, and provide further direction as necessary.

FISCAL IMPACT:

There is no fiscal impact from receiving this presentation. However, the report is comprehensive and would have fiscal impacts on the City if implemented.

STRATEGIC ELEMENT:

This action supports the Healthy Communities and Public Safety elements of the Strategic Plan.

BACKGROUND:

On May 28, 2021, the City Council received a report from resident David Eblovi entitled The Jimenez-Rarback Report on Policing and Public Safety in Half Moon Bay. At its June 1, 2021, Council meeting, Council directed staff to agendize an item for the June 15, 2021 meeting to receive a presentation on the report.

DISCUSSION:

Two guest speakers have been invited by Councilmembers Jimenez and Rarback to discuss the Report and add their voices to the general conversation about public safety in Half Moon Bay. Dr. Greg Woods will focus comments on ethics and accountability in policing, and Sergeant Carl Tennenbaum SFPD (Ret.), will focus comments on the benefits of civilian responders to low-risk calls. Their bios have been provided to the Council under separate cover and are on file with the City Clerk.

At the beginning of the item, staff recommends that the mayor present protocols and an agenda for how the item will go including approximate times for various sections. The item will conclude with Council deliberation and direction.

Thank You Harvey Rarback and Joaquin Jimenez for getting this Important Conversation on the Agenda. It should have been on in 2014 when Yanira Serrano Garcia was killed by a San Mateo Cpinty Sheriff Deputy within 20 seconds of him exiting his patrol vehicle. He had ZERO Plan, He Tampered with the Evidence. That is exactly what happened at the Sandra Lee Harmon Homicide May 5, 2020, NO PLAN and Tampering with the Evidence.

Two Council Members are finally doing what every Elected Official in SMC should have been doing for years.

Half Moon Bay Agendize the Jimenez-Rarback Report.

The Jimenez-Rarback Report was put on the June 15, 2021 Meetings Agenda 4 yes 1 no vote,

This is a San Mateo County Issue not just a Half Moon Bay Issue. It’s rare when an Elected Official actually does the work on behalf of the residents, Here you have two Elected Officials doing what’s right for all of San Mateo County.

San Mateo County Sheriff Carlos G. Bolanos, San Mateo County Counsel David Silberman, District Attorney Steve Wagstaffe and even some Half Moon Bay Council members have said that San Mateo County Sheriff Deputy David Dominguez did not turn on his Body Worn Camera when he exited his patrol car and went to the R.V. he expected Sandra Lee Harmon to be in. By the way he went to the R.V. by himself for some reason, He knew Sandra had a Shotgun and a bottle of wine and had mentioned a Race War. He went alone with BWC turned off is the Government’s Official Story. From the first time that story was presented to the public to this day that is exactly what it is a Story Words Spoken by the Top Government Officials. There has not been one piece of Evidence to support that Story.

Just because somebody says something is true, doesn’t mean that it is. Even if it is the Sheriff.

The Axon Log Records which are paid for by the Taxpayers will prove the statement from the Government Officials is True if it is and False if it is a Lie.

The Staff for the City of Half Moon Bay have demonstrated there complete lack of interest in getting to the truth of what happened the night Sandra L. Harmon was shot in the Back three times all Fatal.

2022 Sheriff Candidate Mark Melville has stated that he will release the AXON LOG RECORDS the first day he is sworn in. Now that makes a reasonable person wonder why Bolanos & Silberman are refusing to provide them and also why the City did not sue them to make them public.

Half Moon Bay Police Reform Zoom Meeting May 18, 2021 Item 3D

Making Half Moon Bay safe for it’s residents.

Great work Half Moon Bay City Council and Resident David Eblovi, Thank You for leading the entire County in Law Enforcement reform. If it turns out that the only resistance is from Sheriff Bolanos and San Mateo County Counsel David Silberman don’t worry both of those obstacles can be gone with the election of Mark Melville for Sheriff in 2022. That’s 18 months from now.

“It’s my understanding their ordinance will have no legal basis on our services, nor on the contract,” Bolanos said. “It’s basically unenforceable.”

Sheriff Carlos G. Bolanos finds those restrictions “problematic” and unenforceable.

Even if the ordinance is approved by the council, it likely wouldn’t have any bearing on the San Mateo County Sheriff’s Office, said Sheriff Carlos Bolanos. Because of the county’s contract with Half Moon Bay, the city can’t legislate changes until the contract is up for renegotiation, Bolanos said. The Sheriff’s Office’s contract with the city doesn’t expire until July 2022

How difficult could it possibly be, HMB has only 2 Deputies on duty per shift.

The proposed ordinance, which was co-written by councilmembers Harvey Rarback and Joaquin Jimenez with the help of resident David Eblovi, states that a law enforcement officer could not stop a car for failing to signal a turn, having expired license tags, or having a defective tail light. In terms of restraining suspects, the ordinance would ban the use of Tasers, chokeholds and prohibit officers from placing people in a prone position while handcuffed. It would require them to be moved on their side immediately if necessary.

The ordinance would also mandate that when dealing with someone who is a threat to themselves or others, officers must wait for backup from another officer or a mental health professional before initiating contact. In addition, officers would also be required to retreat and take cover before firing at an individual. Jimenez noted that public input on this ordinance should be encouraged and that dialogue with law enforcement would be key to making substantial changes happen.

“It’s in our best interest to listen to our community, to see what is going on and if there has to be any kind of changes to make our community safer,” Jimenez said.

While this ordinance would restrict the actions of law enforcement, Rarback believes it would instead give deputies

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HALF MOON BAY

CALIFORNIA AMENDING CHAPTER 2.33, SPECIFIC POLICING POLICIES

THE CITY COUNCIL OF HALF MOON BAY DOES ORDAIN AS FOLLOWS:

Section 1. Findings: The City Council finds and declares as follows:

(a) The municipal code of the City of Half Moon Bay requires periodic updates to reflect current information and changes in law, to provide clarification to the community, and to provide for improved customer service and administration of City business.

(b) Setting a clear understanding for the behavior of law enforcement and peace officers serving the Half Moon Bay community is critical to building and maintaining trust between the community and the City’s law enforcement providers.

(c) Protecting law enforcement officers and the community from undue risk of harm as a result of unnecessary interactions or escalations between armed officers and the public is critical to protecting the public safety of all of Half Moon Bay’s residents, and especially those who may be at statistically high risk of a negative outcome due to mental illness, substance abuse issues, race, housing status, or immigration status.

(d) There is no statutory requirement that the City of Half Moon Bay enforce California Vehicle Code. Therefore the City may, and should, selectively enforce CA Vehicle Code if it results in less pervasive fear or a better standard of living for its people.

(e) It is in the interests of the City of Half Moon Bay for peace officers to have operable and operating video and sound recording devices at all times that they are in public or are engaging in policing activities.

(f) A significant portion of the at-risk population of Half Moon Bay lives in reasonable fear of encounters with law enforcement providers. These fears are justified by the fact that the current law enforcement agency serving greater Half Moon Bay has had numerous recent fatal encounters with individuals who suffered from mental health issues. Therefore, it is in the interests of the public and the officers who serve here to minimize the number and types of such interactions, and when interactions do occur for the City to insure that the interests of all parties are protected to the extent possible.

Section 2. Municipal Code Update (Specific Policing Policies) including revisions to Chapter 2.33 of the Half Moon Bay Municipal Code is adopted as set forth in Exhibit “A” to this Ordinance shown for introduction as deletions in strike through and additions in underline.

Section 3Severability. If any section, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council herby declares that it would have passed this Ordinance and adopted this Ordinance and each section, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.

Section 4Publication. The City Clerk of the City of Half Moon Bay is hereby directed to publish this Ordinance, or the title hereof as a summary, pursuant to Government Code Section 36933, once within fifteen (15) days after its passage in the Half Moon Bay Review, a newspaper of general circulation published in the City of Half Moon Bay.

Section 5Effective date. This Ordinance shall take effect and be in force on the thirtieth (30th) day from and after its final passage.
