Wise words spoken by Julia an 11 year old 6th grader in San Mateo County talking about Foster City elected official Herb Perez who was facing a RECALL effort at the time.

Yesterday I offered Supervisor David Canepa a chance to comment on this article I was working on. He chose not to respond. As many of you know I just recently became aware of the Suspicious Death of Munir Edais a 32 year old Police Officer, Father of two girls, a San Mateo County Resident all his life, a newlywed husband, a son, brother, cousin and friend to many. The Daly City Police Department and the San Mateo County Coroner Robert Faucralt determined almost in a matter of a few minutes that “He Hung Himself” in his Daly City Apartment. How did they conclude this is what happened? It’s simple that is what the new bride told them Case Closed. That was on January 21, 2020, 28 months ago.

One year later David Canepa President of the San Mateo County Board of Supervisors reached out to Munir Edais R.I.P. sister on her instagram account leaving his private phone number saying Call to discuss. The family was thrilled to finally have a high ranking government official make contact with them to help them get the answers they have been fighting so hard to get. They called David Canepa.

Here is what the sister says happened next.

On January 19, 2021, my family and I reached out to supervisor David Canepa, at the time, in hopes of him helping us with our brothers death. My brother, Munir Edais was reported dead on January 21, 2020 by a supposed suicide.
Trying to find some answers answers regarding Munirs death, we reached out to David Canepa. He sent me a private message saying to call him, and left us his phone number. We called him, and got the opposite reaction of what we expected. He was very rude and unsympathetic. He claimed Daly City Police Department had the best investigators and yelled at us saying “what are you guys doing!” He said we need to shut down our instagram page, and rest with the fact that Munir killed himself.

Not what anybody would expect from a Good Person or a Decent Human Being.

Making San Mateo County Safer and Eliminating Corruption has been a project of mine for over 20 years now. I support the Public and Community in the Recall of the Daly City Elected Officials. It is exactly what Jeff Regan recommended shortly after Roger Allen R.I.P. was killed by the Daly City Police Officers who claimed all 4 of them were surrounding the disabled truck with a Flat Tire because “They were there to Help.”

Bay Area Transparency Video made 1 year ago tomorrow, Roger Allen R.I.P. was killed April 7, 2021, 96 days after this video was made. Now I got to see the “We are here to help.” in action. Roger Allen R.I.P. also saw it.

A while ago, We personally reached out to Talika, Roger Allen’s Sister, to express our sorrow and outrage for his murder. And also to offer love and support for Her, Her Family and the Community. 
We remain steadfast on the resignations of ALL Daly City Council Members and the disposal of the City Manager and Assistant City Manager. They are truly trash!
We have been active in sending very pointed and directed email messages and verbal comments to all Council Members as well as the City Manager demanding their departures. We have called dc officials out as racists, murderous cowards. We have verbally vanquished them to Hell. Dropping a few f bombs on them on the way. We verbally broke the DCPD chief and captain in prior meetings as well as moderator leilani ramos and most recently demolishing council member buenaventura. We have reminded them, all Meetings are their LEGACY for their current and future generations to view them as the trash they are. This is pure demonic cowardice evil.
We would like to connect with Community Leaders and Community Organizations in an effort to begin a RECALL effort in early 2022. We think it would be best to connect as a Whole Community. Strength in Numbers!!
We would be more than happy to support all efforts to begin:“Recall the Racist, Murderous DC Council Members.” More than happy to put the banners together.
Please let us know if ALL of us can come together on this. We can connect in early 2022 after the Holidays and as DC City Council Meeting has been moved to Jan 10th, 2022 another display of their cowardice.

Most residents in San Mateo County don’t know that the behavior of the Police Department is the responsibility of the City Manager. The voters of Daly City can not recall the City Manager, The City Council can Fire/Terminate her if they wish too, they don’t. So the only option is to RECALL the Councilmembers.

You may remember the Residents of Foster City, San Mateo County, California recently Successfully RECALLED Herb Perez the vice mayor. You can just imagine how many Political Experts thought that was terrible Idea.

There are many families in San Mateo County who have lost loved ones to Homicide by Law Enforcement. Please keep them in your thoughts.

Foster City, Questions remain about the August 25, 2021, Closed Session Meeting.

I have asked the City of Foster City who was responsible for placing it on the Agenda for both August 25, and August 31, 2021 Closed Session Meetings? There has been no response to those questions.

Just because you have the authority to do something (Fire/Terminate) doesn’t mean that you should, or that it is the right or decent action to take. Super Majority Vote should be considered by the residents. This was clearly an issue between only 3 of the 5 council members. Mayor Sanjay Gehani, F.C. Councilman Jon Froomin voted against the firing of Dr. Peter Pirnejad.

Foster City Council Moving Fast, Interim City Manager.

Tonight 6:00 PM Another Closed Session Meeting.

You will remember it was just a few days ago Richa Awasthi, Sam Hindi, Patrick Sullivan voted to FIRE Dr. Peter Pirnejad, the newly hired City Manager, in a Closed Session Meeting on August 25, 2021. Mayor Sanjay Gehani and councilmemberJon Froomin voted against that.

Tonight in another closed session meeting, guess what they are going to do? Fill that position with the person they planned to fill it with all along.

Why didn’t they just appoint this person at the August 25, 2021 Closed Session Meeting?

What about the wasting of Police Chief Tracy Avelar’s time and energy, as she was just appointed acting City Manager and given a 5% raise with the new title, or the Citizens Ad Hoc Committee, which vetted Dr. Peter Pirnejad which included San Mateo County Manager Mike Callagy. I can confirm the that Mike Callagy had no idea that there was any problem with Dr. Peter Pirnejad with the three councilmembers, and he was completely unaware of the August 25, 2021 Closed Session Meeting which resulted in City Manager being Fired without cause.

This has been a Very Expensive adventure that the Taxpayers of Foster City get to pay, the Nine month salary and benefits to Dr. Pirnejad is about $270,000 plus the Fee to Avery & Associates $23,400 the Recruitment Hiring Firm.

San Mateo County Citizen Oversight FC- Watchdog has more work to do.

This is the group of ordinary citizens that successfully recalled a San Mateo County Elected Official named Herb Perez a Foster City Councilman. One of the items that came up during the Recall Campaign was an Unpaid Sponsorship Fees bill for $17,090.00. So now you have the Government of Foster City giving the RECALLED Politician a Gift of $10,000 and there is no evidence that he has paid or started to pay the previous debt.

Everybody in the Government knows why Herb Perez was RECALLED, the Question is Who approved Gold Medal to receive a $10,000 check in light of the above?

FC-Watchdog submitted a Public Records Act request to the city to inquire about which small businesses received $10,000 from the Business Resiliency fund assistance from Foster City? We received a list today today showing that Gold Medal Martial Arts is a recipient of this fund. We are troubled by this for the following reasons:

Did Gold Medal pay the $17,000 city invoice sent in January for unpaid city event sponsorships?

If not, should Gold Medal be receiving this assistance with an overdue, unpaid balance?

Who approved Gold Medal to receive a $10,000 check in light of the above?

Why is Gold Medal being given special treatment to this day, assuming the $17,000 remains unpaid?

FC-Watchdog is scheduled to meet with the interim city manager next week and we hope to get answers to the above at that time. If you share our concerns, please email council@fostercity.org. The city manager will also receive your email.

Foster City Audit Yes or No?

City Manager Jeff Moneda could have solved this a long time ago, He choose instead to obstruct this simple process. He also chose to resign and remain in that position for two months. Several residents asked by e-mail the City Council to fire him last week before a Closed Door Session about his employment. The meeting took place and there has been no public announcement of the results from that meeting yet. Why?

This issue is a debt for Non Payment of Sponsorship Fees to Foster City by now Recalled Elected Official Herb Perez in the amount of $17,090. That should be pretty simple did Mr. Perez pay this amount Yes or No ? Who should answer that question City Manager Jeff Moneda. It turns out he and others have known this information since mid January 2020.

Mayors Letter to Public

Agenda Item 6-2 A Resolution of the City Council of the City of Foster City Authorizing the Issuance of a Requests for Proposals for an Operational Assessment of the Parks and Recreation Department.

The Public would have no idea that the above Agenda Item was supposed to be about the Non-Payment of Sponsorship Fees by Recalled Councilmember Herb Perez because it wasn’t. That woodcrafting came from City Manager Jeff Moneda and City Attorney Jean Savaree.

The Taxpayers pay all the costs of the City Attorney and for that reason many members of the public believe the City Attorney looks out for their interest, not the case.

Under the Public Records Act, all documents created, owned, or maintained by a public agency are presumptively available for public inspection unless one of the PRA’s exemptions applies. This is no big deal and no reason for a City Attorney to be involved except in a very limited basis, guide the staff in how to prepare. Same is true in accounting matters no reason in the world for City Attorney or their Staff to be conducting accounting when that is what the Financial Depart is paid for already.

All Five Council Members were asking the simple question How much does he owe the City of Foster City, that would imply none of them knew that amount. The City Manager and the City Attorney both knew that amount since January and both chose not to inform the council or the public. Why?

January 22, 2020 the City of Foster City sent a Final Bill by mail for $17,090.00

The readers of this should know this subject of Non-Payment of Sponsorship by an Elected Official would never have come to the publics attention had it not been for a Few Concerned Citizens who sent CPRA.

Foster City Residents asking City Manager Moneda to be Fired.

Foster City Residents who took the time and money to provide True Citizen Oversight by Recalling Councilman Herb Perez who now is permanently labeled as RECALLED. They find themselves stepping up and doing it again with calling for City Manager Moneda to be labeled as FIRED from Foster City. A City Manager is appointed and the public knows very little about what he/she does or what authority they have. This case is pretty simple Mr. Moneda is Obstructing a very simple audit that involves the man who gave him his job.

Foster City Council held a Closed Door Meeting last night about City Manager Moneda employment status. You will recall he turned in his resignation right after the Herb Perez Recall Election Results were certified by Mark Church San Mateo County Elections Officer.

Dear Councilmembers, 

I just finished watching the recording of the last city council meeting. Here are a few comments. 

  1. There were no known issues with the city’s finances before FC-Watchdog discovered these sponsorship non-payments. We found these non-payments by accident while validating sponsorship claims by Mr. Perez. Since we stumbled upon this mistake, how are we confident that this is the only problem? Gold Medal was a sponsor for the Summer Concerts 2019, but I do not see this information mentioned anywhere. No invoice has been sent to them. What else are we missing? Why are we seeking direction from internal staff, the same people who have put us in this mess.  

2.                   Mr. Moneda’s claims that sponsorship non-payments occurred only last year is not true. It has been happening since 2014. The following are unpaid dues by year. (ref: Document 1)

  1. 2014 – $1,000
  2. 2015 – $1,000
  3. 2017 – $9,500
  4. 2018 – $5,000
  5. 2019 – $4,000

3.                   Last year Mr. Moneda wrote a letter to Mr. Perez thanking him for his donation of $74,845.36. I was surprised when Mr. Moneda said he was not aware of the non-payment until September because the letter was written in June. 

4.                   Mr. Moneda mentioned that residents conducted their own audits and came up with different figures without providing the rationale behind it. That is not true. I have sent numerous emails to the city attorney, mayor, vice mayor with details and supporting documents.  On January 10th, Stacy Jiminez and I requested a meeting with director Jennifer Liu and Mr. Moneda, seeking clarifications on sponsorship solicitation, billing/invoicing, payment collection, and cash application.  Mr. Moneda agreed, and the meeting was set up, but he canceled it the next day and never rescheduled. The email exchange is attached herewith.

    Dear Council,
    There is a $17,000+ debt in sponsorship that has not been cleared up to date and the City Manager is now about to quit.
    How can we be able to have a fair audit if the person who can provide answers refuse to answer emails until he is gone?  This behavior should not be allowed and the City Manager needs to be fired immediately. This needs to be on his record instead of being allowed to be dodgy on a matter that shows clear favoritism to a council member who has been recalled. His letter commending Gold Medal of their sponsorships but no email exists for other businesses alongside discrepancies in sponsorships by Gold Medal & Herb Perez all point a finger at shady practices. If it’s not shady, then an audit will show that. 
    An immediate audit is needed before Moneda leaves or ask him to step down effective immediately. 

    I request again for an independent audit on unpaid city sponsorship obligations to be conducted in a timely manner so the breakdowns in city officials’ oversight can be rooted out, fixed, and prevented in future cases.

Dear Council:On Jan. 13, 2020,  Mayor Mahanpour wrote:  “Through that review, it has become apparent that the billing and accounting practices in Parks and Recreation are deficient … In my opinion, the council should look into bringing in an independent third-party consultant to audit the processes, procedures and practices of the Parks and Recreation Department since their records have evidently not been kept in a best practices manner.” 
Why has the independent audit been reduced to an operational assessment?  Please do not cite cost as an impediment to an independent audit.  Most residents are aware that Council is prepared to spend $35 to $40 Million on a new Rec Center.  In my opinion,  money spent on ensuring fiscal integrity is far more important.   
With tonight’s official removal of Recalled Councilmember Herbert Perez,  it is time to usher in a new phase in Foster City government – one that is characterized by Transparency.

San Mateo County Elected Officials should be Decent Human Beings, Most are Not.

Foster City Councilman Herb Perez is just one example. He will be removed and replaced April 1, 2020 when the March 3, 2020 Presidential Primary Election results are Certified. San Mateo County Election Official Mark Church has stated the results will be certified by April 1, 2020 even though California Governor Gavin Newsom extended that date to April 22, 2020.

The Real Question here is what did every single elected official in San Mateo County do to remove Herb Perez from office as soon as they became aware of his behavior. Did any one of them contact Herb Perez by phone, letter or e-mail and suggest he apologize, provide the Black Belt to Julia Vo, promise to change his behavior etc or even resign to avoid a successful recall? It would be good for the public to know how many elected officials contacted Herb Perez.

What did they do to protect this child and her mother once they came forward with this video.

I contacted Herb Perez about the way he treated Catherine Mahanpour during the nomination period for mayor pro tem in 2018/19.  His response was awful and I wrote him off at that point.

He is full of spit and vinegar.

San Mateo County Election Results Extended 21 Days by Gov. Newsom.

Update: March 23, 2020 Mark Church says the March 3, 2020 Presidential Primary Election will be Certified April 1, 2020 barring any unforeseen circumstances.

Public Trust is the Key to Government Functioning. That includes all branches, Sheriff , District Attorney, Judges, Probation, Public Health, County Manager, County Counsel and yes Elections.

Why did Mark Church stop publishing the vote tally? Santa Clara County has continued to update on the schedule they told the public they would.

What difference does it make you might ask? For Foster City Residents it makes a big difference having Herb Perez an elected official recalled remain in office until the vote is certified. For District 13 Senate Race where Sally Lieber is in second place behind Josh Becker in Santa Clara County and she is leading Alexander Glew by 8,499 votes there. This one Senate seat involves both San Mateo County & Santa Clara County. Most of the Political Players in SMC do not want Sally Lieber in the picture. I’ll just give one example the SMDJ with 84,000 viewers wrote an article on Feb. 3, 2020 just in time to influence mail in voters they did not mention Sally Lieber and a few others. They endorsed a candidate who is not in the running. Today Sally Lieber is 1,164 votes out of Second Place where top two vote getters go to the November Election.

The March 3, 2020 Presidential Primary Election results deadline has been extended 21 Days by Governor Gavin Newsom. So final results will be April 22, 2020. As you know Mark Church has not provided an update since March 13, 2020. He also doesn’t seem to know about this order. It’s not on his website.

Important Information about Election Results

The Registration & Elections Division is shifting to minimal staffing for COVID-19 mitigation. In compliance with the order from the County Health Officer, the Elections Division located at 40 Tower Road in San Mateo will be closed to the public effective Tuesday, March 17 as a precautionary measure. 

The Registration & Elections Division will continue to process all ballots as normal. The election will be certified no later than April 1, 2020, within the statutory deadline. The next results report will be the official Statement of the Vote.

Foster City Councilman Herb Perez Recalled

San Mateo County Politician Herb Perez was Recalled March 3, 2020 and the results will be certified within 30 days of that date.

Herb Perez is a business owner and Councilman in Foster City who was about to be termed out. The political experts in the county suggested the concerned citizens who are the Only Oversight of elected officials in reality to let him get termed out and just don’t vote for him in the future. A Recall is expensive and very time consuming and the odds are it will fail.

Herb Perez responded to the Petition for Recall with this statement. “They cannot name a single wrongdoing.” Really did he watch their Videos?

During public meetings he has openly called residents fools, morons, miscreants, malfeasants and ultracrepidarians as a form of intimidation.

The recall effort was organized by a group called FC Watchdog, which accused Perez of “open disdain for residents” and pro-development agenda. Jeff Regan, an organizer for the recall, said about the recall effort, “It’s because when a resident goes up to speak publicly and gets treated with disdain — that blocks democracy and it’s an intimidation tactic. At a certain point, enough is enough.”

Tuesday’s election also chose his successor former police Capt. Jon Frooman

Herb Perez could have avoided having the title RECALLED added to his name & resume by simply being Civil, he choose not to. He chose to sue instead, file criminal allegations to the District Attorney’s Office who declined to move forward. He saw that more than 4,300 people signed the recall petition that is enough to pass the recall.

The question for the other elected officials who served with Herb Perez on the Foster City Council. Why was his behavior OK with you?

As of this afternoon there are 7,275 Yes votes to recall which is 77.28%

March 6, 2020 I had the privilege of attending the celebration and acknowledging of all the volunteers that made this result possible. I was impressed by the age swing from very young to the Seniors but most notable was the Women involved. One woman made the comment that she and her Granddaughter went door to door. I thought that was so cool. I also noticed that Reporter Annie Berman of KQED was the only other News Media that attended the most Important Election Story in San Mateo County this year for sure.

I couldn’t help but notice the absence of any San Mateo Daily Journal reporter at this event. Jerry Lee and Jon Mays chose not to cover it. Why?
