Former San Mateo County Sheriff Deputy Juan P. Lopez is in court today January 12, 2022 at 9:30 A.M. in Courtroom 2G. The Judge hearing the Motion is Hon. Judge Joseph Scott.

You will recall that Defense Attorney Tony Serra respectfully asked Judge Scott to recuse himself for Bias. He hired a law firm in Riverside and declined.

San Mateo County Counsel Attorney Joseph Charles is representing SMC District Attorney Steve Wagstaffe who has been doing everything possible to not have to Testify underoath in this case.

The six charges that are in court today over 7 years after District Attorney Steve Wafstaffe gave a News Press Release in front of Television crew to announce that Sheriff Deputy Juan P. Lopez was Arrested and Charged with Smuggling a Cellphone and Drugs into the Maguire Jail and gave them to a Hells Angel Gang Member. That NEVER Happened.

On that day standing in front of those News cameras, District Attorney Steve Wagstaffe, William Massey, John Warren, Jordan Boyd, Sheriff Carlos G. Bolanos, Sgt. Jason Peardon, Lt. Andrew Armando, San Mateo County Counsel all knew or should have known those charges were 100% FALSE.

Now today in court the remaining 6 charges and the ONLY charges that DDA Kimberly Perrotti want the jury to hear or know about is Mortgage, Insurance and Election Fraud.

Did Sheriff Deputy Juan P. Lopez vote from Both of his residences? Nope only Redwood City, where his car was broken into. That is where Jordan Boyd knew he lived.

Remember in 2014 Sheriff Deputy Juan Pablo Lopez reported to the San Mateo County Sheriff Office that his car was broken into in the garage area of his Redwood City Condo. When he was asked by the Deputy who took the report, do you have any idea who might have done this?

Sheriff Deputy Juan P. Lopez responded, “The San Mateo County Sheriff’s Office Gang Task Force.”

Has the SMCDA’s Office ever asked the Gang Task Force to break into cars? Ask Jamie Draper.

I am 100% in favor of the San Mateo County District Attorney’s Office and the Sheriff’s Office making sure that their employees are honest. That they would NEVER file a False Police Report, or Affidavit for a Search Warrant, or check the owner occupied box on a Mortgage Refinance Application, or spend the Insurance settlement Check received for damage in the Kitchen on something else. You want to make sure you employees are the right Moral Character like the 45 mentioned in the Gross Misconduct in the San Mateo County Sheriff’s Office Document.

Has SMCDA Inspector Jordan Boyd started his own investigation of any of the 45 men named. There is a pretty good chance he would find some Mortgage and Insurance Fraud cases in that group.

Details surrounding the arrest are unclear.” Welcome to San Mateo County, That is the first of many RED FLAGS.

Aldon Smith might have been kicked off of several NFL TEAMS but he is on the “Those Who Matter” TEAM, in SMC. That is the Last Thing he needs.

His Defense Attorney Joshua Bentley is most likely on his cell phone speed dial. Sheriff Carlos G. Bolanos and District Attorney Steve Wagstaffe numbers are on Joshua Bentley’s speed dial.

TMZ reported “Details surrounding the arrest are unclear.” How is that possible in 2021. What could be unclear about an arrest that takes place around 2:30 PM and Booked in jail at 7:38 PM. Where was Aldon Smith for those 5 hours?

What date and time did San Mateo County Sheriff Carlos G. Bolanos provide the 760,000 residents with a Press/News Release of Aldon Smith’s ARREST for DUI BAC .288 which is over 3 times the legal limit? Sheriff Bolanos Never did provide that information, WHY?

In 2018 Aldon Smith was arrested for DUI with a BAC of .40 which is 5 times the legal limit, and that happened with him wearing a SCRAM device.

Don’t expect this Felony Criminal Case to go much different, than the Sheriff Sergeant Lou Aquino DUI case, the Zainali Jaffer Criminal Case, or the San Mateo County Sheriff Activities League (SAL) Embezzlement & Money Laundering Criminal Case with Barbara Bonilla being the only person charged when there were others.

This is a “Those who Matter” case, San Mateo County Sheriff Carlos G. Bolanos provided NO BOOKING PHOTO or PRESS/NEWS RELEASE of the arrest. Why?

That is the first Tell. The 2nd Tell is Defense Attorney Josh Bentley, The 3rd Tell District Attorney Steve Wagstaffe filed this case as a Misdemeanor 21-SM instead of a 21-SF which is a FELONY.

Smith declined a field sobriety test but later took a blood test that showed a blood-alcohol content of .288 percent, District Attorney Stephen Wagstaffe confirmed Thursday. Smith spent the night in jail. (source San Jose Mercury News Michael Nowels)

By declining a sobriety test at the scene, you forfeit California Drivers License for 1 year, unless you are one of the “Those Who Matter” TEAM.

If he was a BAC of .288 why is he charged with a 0.08?

San Mateo County has a First Chance DUI program for 1st time offenders. To my knowledge it does not have a 4th or 5th Chance DUI Program.

San Mateo County does have Defense Attorney Josh Bentley, Watch this case, it is going to be exciting.

TMZ was the first to report the arrest on December 6, 2021.

When I say watch this case, I mean show up to Court IN PERSON. A reasonable thinking person would know that there is a COVID-19 Pandemic in San Mateo County at this time. Listening by phone to the Court Hearings would be a lot safer you would think. Superior Court of California County of San Mateo Presiding Judge Leland Davis III thinks just the opposite. He cancelled Public Access by Telephone on November 22, 2021.

If you do attend the next Court date don’t be surprised if Aldon Smith and Josh Bentley appear remotely for safety reasons. Who would blame them. Stay Safe

Yesterday December 13, 2021 in Courtroom 2G Hon. Judge Joseph Scott the San Mateo County Superior Court Judge who refused to RECUSE himself for bias comments he made on July 27, 2021 about x Sheriff Deputy Juan P. Lopez criminal case NF433910A. The comments were made/heard/recorded on the Public Access Telephone Line 1-206-279-9591 Code 631595. The comments were made after the short 5 minute hearing was completed and Court Clerk Katrina Bihl left the phone line active instead of muting it which she has claimed under the penalty of perjury a PC115(a) Felony, that she did mute it.

On November 22, 2021 Superior Court of California San Mateo County Presiding Judge Leland Davis III discontinued the Public Access Telephone Lines. He now invites the Public to attend in Person during a PANDEMIC.

John Warren looks like a fun guy, why wouldn’t San Mateo County Counsel Attorney Joseph Charles or the Government of San Mateo County want him to Testify in the Sheriff Deputy Juan P. Lopez case?

He was the Supervisor of SMCDA Inspector William Massey and Inspector Jordan Boyd. You couldn’t find three more Important Individuals in the Selective Bad Faith Prosecution of a San Mateo County Sheriff Deputy.

How many of the 45 Male San Mateo County Sheriff Employees were ever Investigated by the Redwood City Police Department and the San Mateo County District Attorney’s Office? They were Distributing Pornography and a VIOLENT RAPE VIDEO on San Mateo County Computers located in the 400 County Center Building. How many of the 45 SMCSO Employees shared that Porn with under aged girls or boys?

Ask Sheriff Carlos G. Bolanos, Sheriff Captain Christina Corpus or D.A. Steve Wagstaffe what did they do when they found out about it?

November 23, 2021 Dr. Dylan Edward O’Connor pled nolo contendere to one count of PC 288.2 a misdemeanor. Why was he Investigated at all and the 45 San Mateo County Sheriff Employees never Investigated. He lost his career, What did any of them lose? Nothing.

Dr. Dylan O’Connor’s next court appearance is February 28, 2022.

Superior Court of California San Mateo County has cancelled Public Access by Phone as of November 22, 2021, Why?

Evidently the Pandemic is over and Somebody in San Mateo County is inviting the public to attend Court proceedings in person in the 400 County Center Building, Redwood City, California.

There is no Press Release or Official Notice of this change on the Courts Website. Why?

I was on the Public Access phone line for 3 hours waiting to hear the court proceeding just like I have done many times this last 2 years. The phone line and code worked perfectly, other than I got disconnected about 8 times and had to re-dial which I did. At no time was there a notification that the Telephonic Public Access had been discontinued. I checked the Court case file and saw it was already Held and Completed.

Here are 10 other Counties close to San Mateo County, They still think there is a Pandemic.

Who would want to cut off the Telephonic Public Access? A more important question is WHO did cut it off? What has recently happened in San Mateo County Superior Courts that would caused this change. The only thing I can think of is recently, Hon. Judge Joseph Scott, his Court Clerk Katrina Bihl and the Court Reporter all conspired and committed Perjury in the x Sheriff Deputy Juan Pablo Lopez 7 year criminal case.

Seven years and San Mateo County Sheriff Deputy Juan P. Lopez (retired) has not been convicted of one single crime. Think about that.

The reason I call him a Psychic Inspector is the 7 year Political Prosecution Criminal Case against San Mateo County Sheriff Deputy Juan Pablo Lopez. I’ve reported that Inspector Boyd was waiting in his office for Deputy Lopez to be escorted to him to be interviewed, he asked Sheriff Deputy Lopez for his California Drivers License, Deputy Lopez took it out of his wallet and handed to D.A. Inspector Jordan Boyd. Boyd simply looked at it and informed Deputy Lopez that it was Suspended by a court in Los Angeles.

Judge Joseph Scott to Recuse himself from this case number NF433910A, The reason was simple, the Hon. Judge Joseph Scott was heard on the public access phone line to the Court saying” “Well, he got lucky and got away with the first one, but we will see about this one.”This statement was made to his Court Clerk Katrina Bihl after the Court Hearing had ended and Sheriff Deputy Lopez (retired) and his attorney had left the Court Room.

San Mateo County Superior Court Clerk Katrina Bihl filed a false instrument with the court under the penalty of Perjury that she had muted the phone line right after the hearing was complete, as she always does, and denied Judge Scott’s statement “Well, he got lucky and got away with the first one, but we will see about this one.” was ever spoken in the courtroom. San Mateo County District Attorney’s Office Psychic Inspector Jordon Boyd who is also a Cell Phone Expert got the phone records to prove that the statement made by Judge Scott “Well, he got lucky and got away with the first one, but we will see about this one.” could never have been heard because the phone line would have been hung up as soon as the court hearing was completed. That is not what the phone records show, They show the top line is the Host which is Katrina Bihl opens the phone line at 9:14:03 AM and Disconnects the line at 10:43:64. The Hearing was at 9:30 AM for about 5 minutes.

Inspector Jordan Boyd and Prosecutor Kimberly Perrotti never called me to find out what I heard Court Clerk Katrina Bihl say to the Bailiff about Simone Biles an Olympic Champion. A reasonable person would think the lead Investigator would like to speak to everyone who was on that call, after 9:35 AM not the case here.

Remember he was Charged with smuggling a cellphone and drugs to a Hells Angel Inmate at Maguire Jail. What ever happened to those charges?

Attorney general opens field offices to investigate fatal police shootings across state.

SACRAMENTO — The state Department of Justice has opened field offices throughout California to investigate police shootings that kill unarmed civilians and has told law enforcement agencies that they must notify the state whenever such incidents occur, Atty. Gen. Rob Bonta said Wednesday.
The actions, including the opening of investigative offices in Los Angeles and Riverside, were in response to a new law that took effect July 1 requiring Bonta’s office to independently probe all fatal police shootings of unarmed civilians to determine whether criminal charges should be filed against officers.
Bonta said he expected the two new teams, one for Northern California and one for Southern California, would investigate 40 to 50 fatal police shootings each year based on historic trends.
“One of the most important tasks ahead for public safety and our society is building and maintaining trust between our communities and law enforcement,” Bonta said. “Impartial, fair investigations and independent reviews of officer-involved shootings are one essential component for achieving that trust.”
The attorney general said 27 special agents and six supervisory agents would make up the California Police Shooting Investigation Teams. The Northern California office is in Sacramento.
Assemblyman Kevin McCarty (D-Sacramento), author of the new law, said he was concerned that the state Department of Justice had denied requests from some community leaders to undertake independent investigations of several high-profile police shootings.
The state DOJ has traditionally deferred to county prosecutors, who have handled such cases after investigations by the law enforcement agencies involved.
“Police shouldn’t police themselves, and the current system is fraught with conflicts of interest,” McCarty said during debate on the bill. He noted he had first proposed such legislation in 2015 and since then more than 800 people had been shot and killed by police in California.
The measure, Assembly Bill 1506, was opposed by some law enforcement groups, including the California State Sheriffs’ Assn., which said it could result in duplicate state and local investigations and that the state DOJ lacked the resources and was not equipped to take on the new responsibilities.
The measure “bypasses local investigatory processes, including established agreements to have outside agencies investigate officer-involved uses of force,” the association said in its opposition letter to lawmakers last year.
On Wednesday, Cory Salzillo, the association’s legislative director, said in a statement: “The sheriffs continue to work closely with the attorney general and Department of Justice on the implementation of procedures for the authority described in AB 1506.”
Under the law, the DOJ must investigate the fatal police shootings and submit a written report that states the facts of the case, its analysis, provides a conclusion on each issue raised by the shooting and recommends whether policies of the law enforcement agency should be changed.
If the DOJ determines criminal charges are warranted, it would prosecute the officers.
Bonta said his office would also continue to conduct “pattern and practice” investigations of law enforcement agencies if there appear to be problems beyond one incident. Those kinds of investigations, aimed at determining whether reforms should be pursued, are ongoing involving the Los Angeles County Sheriff’s Department and the Vallejo Police Department.
On Wednesday, Bonta formally launched the new investigative teams and released the guidelines and protocols his office would use in investigating fatal police shootings, saying his agency will make public its investigative findings, including explanations when a decision is made not to seek a criminal prosecution.
Bonta said investigators would be deployed throughout the state with an emphasis on areas where there had historically been the most police shootings.
The field offices will allow investigators to get to the scenes of shootings quickly, he said.
The shooting investigation teams “will work in coordination with local responding agencies throughout the investigation of the officer-involved shooting, and members … will serve as concurrent, independent special agent investigators of these critical incidents,” the DOJ said in a statement.
Once an investigation is completed, the case will be turned over to the DOJ’s Special Prosecutions Section within the Criminal Law Division for review.
Administrative or civil investigations remain the responsibility of the law enforcement agency that employs the involved officers.
Bonta was a state assemblyman before Gov. Gavin Newsom appointed him attorney general in March to fill a vacancy left by Xavier Becerra’s departure to become U.S. Health and Human Services secretary in the Biden administration.
As a lawmaker, Bonta was a co-author of the legislation he is now implementing.
He said during a news conference Wednesday that the investigations would not be easy but that he expected local law enforcement would cooperate.
“I’m honestly not expecting a lot of pushback or tension or obstacles,” Bonta said. “We will be prepared for any that do arise.”
Representatives of the LAPD did not immediately respond to requests for comment on the new state investigation teams.
The Los Angeles County Sheriff’s Department will “enthusiastically work collaboratively” with the DOJ in investigating fatal shootings of unarmed civilians, said Capt. John Satterfield, adding that the “goal is to assist the DOJ in completing a comprehensive, fair and impartial joint investigation.”
The state budget approved for the fiscal year that began July 1 includes $13 million to staff the investigation teams.
The DOJ said before Bonta’s appointment that it would need $26 million to properly investigate the 40 deadly police shootings that the state averaged each year.
He said Californians deserved an independent and transparent process for determining whether police officers acted properly when shooting unarmed civilians. He also said the issue was personal for him.
“I’ve heard firsthand the hurt and the pain that too many families and communities feel in the moments after these incidents,” Bonta said. “I have witnessed the lack of trust that these investigations will be treated fairly by our criminal justice system.”
