San Mateo County Sheriff S.A.L. xExecutive Director Barbara Bonilla Embezzlement Investigation is still ongoing.

By. Michael G. Stogner

Barbara Bonilla

During the City of Half Moon Bay Special Meeting held September 1, 2020, San Mateo County Sheriff Captain Saul Lopez gave his annual report to the Council. Part of his report included the Sheriff Activities League and all the efforts his Deputies had accomplished and how many children and families were impacted. After his presentation Councilman Harvey Rarback asked probably the most important question of the entire meeting. He asked Captain Saul Lopez if he could comment on the SAL financial situation?

San Mateo County Sheriff Captain Saul Lopez

That situation would be the DOJ Embezzlement and Laundering Investigation of Barbara Bonilla that has been going on for a long time. I was the only reporter to write about it on February 28, 2020 and at that time I could only report that Barbara Bonilla was escorted out of her office and was on administrative leave. Since that time we know she has quit the SMC Sheriff’s Office, which I still don’t know why, has been removed from the State & National PAL Organizations. To this day she has not been charged with any crime. I now know thanks to Sheriff Captain Saul Lopez that that Investigation by the Department of Justice is ongoing and he informed the council he was unable to comment on the subject.

My question to the Half Moon Bay City Council and the City Manager is this, What was the first date that Sheriff Captain Saul Lopez informed you that the Top Executive for the San Mateo County Sheriff Activity League was removed from her office and there is an Investigation ongoing. Was it before my article February 28, 2020? Did he ever report it to you?

The meeting also pointed out exactly how our system works, SAL interacts with children teaching them important life lessons and when one of the adults gets caught, the children learn how the system really works, the adults keep quiet, nobody talks about it. The entire council should put this subject on the agenda. Ask Captain Saul Lopez what did he know and when did he know it?

NO MASK NO RIDE NO MASK NO DRIVE

Fire who ever approved the SOFT APPROACH to enforcing masks.

Send drivers home who don’t wear masks. Mike Levinson, chair of the San Mateo County Paratransit Coordinating Council, during the meeting said SamTrans bus drivers themselves are not always wearing masks.

Todays SMDJ

A SamTrans board member and others called for stricter enforcement of face coverings aboard buses at a meeting Wednesday.

While masks are currently required when in public, SamTrans has been taking a “soft approach” to enforcing the rule on its buses, said Chief Operating Officer David Olmeda during the meeting.

SamTrans Board Member Charles Stone, also Belmont vice mayor, wants that to change.

“Morally I think we have an obligation to institute a mandatory face covering rule as soon as possible,” Stone said. “I think we have to abandon the soft approach and go with a much stricter approach.

“No one should be getting on our buses without a face covering,” he continued. “It’s not just about the health and safety of other riders. It’s about the health and safety of our operators as well.”

Olmeda said the “soft approach” to enforcement was implemented to avoid altercations between bus drivers and defiant riders.

“One of the things we’ve learned from other transit agencies is when we take a very hard line or depend on the operators to take a hard line we increase the opportunity to get aggression and have problems on board our vehicles,” Olmeda said. “We’ve taken a softer approach because quite frankly at this point in time everyone understands in society that masks are required.”

Instead of having drivers enforce the mask requirement, automatic messages and signs on buses “encourage” the use of face coverings, Olmeda said.

Stone argued that managing insolent riders is part of the bus driver’s job description, adding the agency’s drivers are up to the task.

“I’m certainly sensitive to the fact that we don’t necessarily want our operators to have to deal with the unpleasant situation if someone doesn’t want to wear a face covering, however, I know our operators are really good at dealing with difficult customers already. They’re fantastic about that,” he said. “You have to be able to deal with folks who are not necessarily listening to you when you tell them don’t come over the line or sit down while the bus is in motion. … I think they can handle this.”

Mike Levinson, chair of the San Mateo County Paratransit Coordinating Council, during the meeting said SamTrans bus drivers themselves are not always wearing masks.

“We’ve had a couple of complaints from riders that drivers on Redi-Wheels have not had masks and they’re assisting people with wheelchairs and seat belts,” he said. “I completely agree with [Stone’s] sentiments.”

Officials did not indicate whether the SamTrans’ mask enforcement policy will change in the near future, but Olmeda said the agency is currently exploring whether to store masks on buses so they can be given to riders who don’t have them.

During the meeting, officials said a blend of local and school service will be restored by August. Certain bus lines including the Route ECR that services El Camino Real as well as 23 community routes in low-income areas will return to preCOVID-19 service levels, though other routes will be suspended. Suspended routes include the SFO, which services the airport, and FCX, which travels between Foster City and San Francisco, as well as 15 community routes.

Officials also noted average weekday ridership on SamTrans has been increasing 6% to 8% week over week over the past three weeks.

SMC District Attorney Steve Wagstaffe says Nice words about George Floyd’s Murder & Racism.

By Michael G. Stogner

Steve-Wagstaffe

D.A. Stephen M. Wagstaffe

Condemnation Racism And Bigotry

As District Attorney of San Mateo County, I join the other District Attorneys in California in condemning the senseless death of George Floyd in Minneapolis. I extend condolences to the family of George Floyd and to the communities across this nation that are in mourning over Mr. Floyd’s death. As a society, we must bring an end to bigotry and racism in our country, and it is the solemn responsibility of all government leaders and every member of the criminal justice system to achieve this goal. The citizens of this country cannot rest until we bring an end to racial inequity and racism in our country. After 43 years as a prosecutor in San Mateo County, it saddens me that shocking events such as Mr. Floyd’s death and the violence that followed continue to occur. We will continue to collaborate with San Mateo County law enforcement agencies to train their officers to insure proper and lawful conduct by officers and to appropriately investigate any conduct that violates the law. Every member of the San Mateo County District Attorney’s Office will resolutely continue to seek justice and fairness in our criminal justice system. To this end, I have signed the attached statement of the California District Attorneys Association issued this past weekend condemning racism and bigotry. I hope and pray the principles enunciated in this statement may soon be achieved.

Stephen M. Wagstaffe
District Attorney

The Prosecutor the Judges are talking about below is Stephen M. Wagstaffe “his ulterior motive was race-based.”

[22] But Jefferson was not the only African-American the prosecutor peremptorily challenged. He also struck the only other African-American potential juror, and, in so doing, pro- vided several pretextual explanations for that strike. In light of this additional strike, the prosecutor’s proffer of two ques- tionable explanations for his strike of Jefferson take on a sig- nificance that they might otherwise lack. See Lewis v. Lewis, 321 F.3d 824, 831 (9th Cir. 2003) (“The proffer of various faulty reasons and only one or two otherwise adequate rea- sons, may undermine the prosecutor’s credibility to such an extent that a court should sustain a Batson challenge.”). At a minimum, these dubious explanations reaffirm our conclusion that the prosecutor’s actual reason for striking M.C. differed from those that he asserted and that his ulterior motive was race-based. See Kesser, 465 F.3d at 369 (“The prosecutor’s willingness to make up nonracial reasons for striking [three minority jurors] makes it even harder to believe that his rea- sons for striking [a fourth juror] were race-neutral.”).

IV. Conclusion

[23] Taken as a whole, the record compels a finding that the prosecutor’s non-race based reasons for peremptorily striking M.C. were pretexts. The fact that the prosecutor peremptorily struck the only other African-American juror in the jury pool and provided at least two implausible reasons for that challenge reinforces this conclusion. We therefore hold that both the California Court of Appeal and the district court clearly erred when they found that Ali failed to establish pur- poseful discrimination. We further hold that, in light of the overwhelming evidence indicating that the prosecutor in Ali’s case acted with discriminatory intent when he struck M.C., the California appellate court’s finding to the contrary was an unreasonable determination of the facts in light of the evi- dence presented in the state court proceedings. See 28 U.S.C. § 2254(d)(2). We therefore reverse the judgment of the dis- trict court and remand with directions to issue a conditional writ of habeas corpus requiring Ali’s release from custody, unless the State elects to retry Ali within a reasonable time to be determined by the district court.

REVERSED and REMANDED.

Mark Simon Joins the Victim Shaming/Bashing TEAM.

By Michael G. Stogner

May 14, 2020 Mark Simon wrote an article titled “An unusual Harbor District Meeting” the typical Victim Shaming piece which is something he is quite skilled at. This article is about a SMCHD meeting that took place 29 days prior to his article. He has joined Congresswoman Jackie Speiers Daughter Stephanie Sierra of ABC 7/KGO in the Victim Shaming plan of attack. Also on the TEAM is Supervisor Don Horsley, Assemblyman Kevin Mullin (Mark Simon’s partner) I can’t wait to discover who is the Captain of this TEAM and who is responsible for forming it.

I would suggest Mark Simon consider the May 26, 2015 as an unusual meeting it was very exciting and I know he attended I just don’t know why?At the time he worked for SamTrans.

First of all this April 15, 2020 meeting was not unusual for the Harbor District, I’m not sure how many meetings Mr. Simon has actually attended I have attended several and the yelling and cutting each other off especially Virginia Chang Kiraly to Sabrina Brenna is normal Virginia doesn’t like Sabrina similar to how Mark Simon feels about her.

Mark Simon who supports the Perpetrator says Her vehicle for this behavior was a long-standing dispute with fellow Commissioner Tom Mattusch, who in 2014 foolishly circulated some raw pornography to about 40 people. Mark doesn’t mention the Invitation for all expense paid Safari trip Tom Mattusch offered Sabrina.

So it’s Not ok with Mark Simon for Victim Sabrina Brennan to speak about female genitalia but is ok to mail unwelcome porn, which is exactly what Commissioner Tom Mattusch sent her and all the other Commissioners, Supervisor Don Horsley, Assemblyman Mullin, Mark Simon, and Stephanie Sierra ABC 7/KGO are cool with that. Together they want/wish Sabrina Brennan to just SHUT UP, Move On. That is the same that all Child Molesters (SMC Dr. William Ayers) and their Enablers want/wish of their Victims.

John Ullom at 29:20 Mark He and brother Dan own Citizen Access TV, somebody stole his broadcasting device, They were broadcasting the meeting live for FREE. Somebody didn’t want that to happen.

The true picture of Mark Simon, a Loud & Vile Bully, Victim Shaming/Basher.

As a Private Victims Advocate for the last 22 years in San Mateo County I find the way to get a victim to stop talking about a subject is to deal with it Honestly in the first place. Victim Shaming, and telling the Victim to Shut up is a guarantee that you will hear about it at Every Single Meeting.

“I will continue bringing up my harassment at these meetings,” she said. “I won’t be silenced.” Sabrina Brennan.

Lenny Mendonca quietly resigned on Good Friday.

By Michael G. Stogner

Lenny Mendonca abruptly resigned April 10, 2020. He’s no longer the CA Chief Economic & Business Advisor to Gov Newsom and he’s no longer serving as the Chair for the CA High Speed Rail Authority.

The California High Speed Rail Authority just had a meeting April 21, 2020. They were forced to disclose an Investigation, They disclosed a watered down version of what is really happening. They reported that the consultant WSP hired their own Attorney to Investigate the Whistleblowers Allegations.

Everybody knows that is not a real Investigation.

The investigation disclosure was made at Tuesday’s board meeting in response to a question raised by board member Martha Escutia, a former state senator and now USC vice president for government relations. Escutia said she raised the matter because it was important to protect the integrity of the project.

Thanks to the LATIMES By RALPH VARTABEDIAN we now know there are two Criminal Investigations. This was not disclosed at the meeting.

The project is being investigated by the criminal division of the U.S. Department of Transportation’s Inspector General, and the F.B.I.

As most San Mateo County Residents know Lenny Mendonca is the owner of the Half Moon Bay Review and his Newspaper didn’t see this as a Newsworthy Story.

“Unqualified trust relationship with this partner.” Hon. Judge Lisa Novak

By Michael G. Stogner

CarlosG.Bolanos

Sheriff Carlos G. Bolanos

In a response to the Commission on Judicial Performance .

The Commission on Judicial Performance, established in 1960, is the independent state agency responsible for investigating complaints of judicial misconduct and judicial incapacity and for disciplining judges, pursuant to article VI, section 18 of the California Constitution.

Somebody filed a complaint against Judge Novak because she notified all the Judges present at the June 20, 2017 Judges Meeting, She had made a finding that SMCSO Sergeant Michael E. Otte Perjured Himself in her courtroom.

The person or persons who filed the complaint was not concerned at all by the fact that a SMC Sheriff Sergeant would lie under oath in her court, the person and the CJP was only concerned that she informed all the Judges who attended.

She noted the close relationship between the Sheriffs Office and the Court and cited the need to have an unqualified trust relationship with this partner.

Lets look at this unqualified trust relationship with the Sheriff’s Office under the leadership of Carlos G. Bolanos.

In-Custody Homicide of Chinedu Okobi three False News Releases. Omitting 6th Sheriff Employee for starters.

San Mateo County Sheriff Sergeant Lou Aquino DUI arrested by RWCPD September 14, 2019 Sheriff Bolanos refuses to release the Booking Photo. Why?

San Mateo County former Sheriff Deputy Juan P. Lopez criminal case going for more than 5 years with the sole purpose to cause harm to him mentally and financially. The public might recall the big Press Conference claiming Nobody is above the law in San Mateo County and Charging Deputy Lopez with Smuggling a Cellphone and Drugs to a Hells Angel member in Jail. Sheriff Carlos Bolanos knew there was No Evidence to support those charges.

These are just three current examples unqualified trust relationship with the Sheriff’s Office under the leadership of Sheriff Carlos G. Bolanos.

An older example when Carlos G. Bolanos was Undersheriff 2010 the Brave Female Deputy reporting the 46 San Mateo County Sheriff Male Employees receiving and sharing Porn and Rape Video on County Computers.

It is my experience that Judges in San Mateo County have allowed Sheriff Employees and District Attorney Employees and County Counsel Employees to lie/file false instruments and give False Testimony on a daily basis, this is the Norm it shouldn’t be.

I say you can’t possibly manage what you don’t measure.

Lets find out exactly what happened after Hon. Judge Lisa Novak made a finding that SMCSO Sergeant Michael E. Otte Perjured Himself in her courtroom.

San Mateo County District Attorney’s Office Top Two Investigators being Investigated. By Who?

By Michael G. Stogner

This might come as a surprise to the residents of San Mateo County but Attorneys file False Instruments with the Courts every single day, Would the San Mateo County Counsel’s Office do it? Sure it’s possible, lets find out. The District Attorney’s Office had 73 days to Investigate Massey and Warren, why the long delay. Who’s left in the D.A.’s office to conduct an Internal Investigation of the top two anyway?

Update: 1/10/2020 San Mateo County Counsel Attorney Joseph F. Charles appeared and his two clients D.A. Inspectors William Massey and John Warren remained outside the courtroom for several hours. They did not take the witness stand but never the less it was good to see them there. Mr. Charles asked for and got his Motion to Quash Subpoenas filed Jan. 07, 2020 SEALED. Why would he ask for that?

Another attorney (female) from San Mateo Counsel Office representing the Five Sheriff Employees who were there to testify and one unnamed Sheriff Employee involved in a Belmont “incident” while not on duty many years ago, and had nothing to do with Sheriff Deputy Juan P. Lopez ( according to her) was there to make sure the Belmont Police report was not only not made public but that Juan Lopez’s Attorneys could not see it either. The Judge temporarily SEALED it to give the Government time to file a motion to seal.

Note: Attorney David Washington sued the City of Belmont November 13, 2014 for not providing the Police Report involving Sgt. Jason Edward Peardon, I know this because I filed the suit and personally served the City of Belmont Attorney. The PADP did a story on it the next day, the attorney claimed the suit was unnecessary and a phone could have resolved this matter. Within a couple of days the City of Belmont retained a Law Firm across the bay and Never provided the Police Report.

The Statement by San Mateo County Counsel that “Sheriff Sergeant Jason Peardon has nothing to do with the Sheriff Deputy Juan P. Lopez.” case is Laughable, He is the Juan Lopez case. Finally the Belmont Police Report surfaces only to be SEALED.

According to a Motion to Quash Subpoenas filed Jan. 07, 2020 by Deputy Counsel Joseph F. Charles SBN 228456 in Case No. NF433910A former Sheriff Deputy Juan P. Lopez. Mr. Lopez’s next court date is Tomorrow Jan. 09,2020 9:00AM SSF court Hon. Judge Danny Chou.

San Mateo County Counsel John Beiers Office just filed a motion Yesterday Jan. 7, 2020 to Quash Subpoenas for District Attorney’s Office Senior Inspector William Massey and Chief Inspector John Warren to testify tomorrow.

“In response to the October 28, 2019 Citizen Complaint served by Defendant Lopez, the San Mateo County District Attorney Office has commenced an Internal Investigation into  the allegations made by Defendant in his October 28, 2019 Citizen Complaint has recently commenced, is ongoing, and will not be completed until after the completion of the Defendants underlying criminal trial.” This internal investigation subsumes all of the factual issues raised in the Citizen Complaint which include events that transpired as far back as 2015. More importantly Defendant’s criminal trial is likely to reveal the names of witnesses, events, information and additional evidence directly relevant to the District Attorney Office internal investigation into alleged misconduct (and potentially criminal misconduct) allegedly engaged in by law enforcement personnel.

How do they know when x Sheriff Deputy Juan P. Lopez’s underlying criminal trial is going to be completed?

What date was this Investigation opened and Who is conducting it?

Why wasn’t this Investigation opened several years ago when Sheriff Deputy Juan P. Lopez filed a lawsuit with the exact same complaint?

thumbnail-2Senior Inspector John Warren, Lets hope this is on his off time.

Update 5:40 PM 1/8/2020 No response from San Mateo County Counsel John Beiers yet.

Michael:
I hope you also had a good holiday season.
As you may know by now, yesterday the court ordered the Citizen’s Complaint and any information related to it including the DA’s internal investigation, sealed from disclosure as a confidential record.  Therefore, the County is not at liberty to discuss the investigation or answer any questions about it because to do so would violate the court order.

Best,

John

Chinedu Okobi In-Custody Death, San Mateo County Sheriff’s News Release was a lie. “Suspect Immediately Assaulted the Deputy,” Why?

Fact: There was No Immediate Assault of a Deputy. Sheriff Carlos G. Bolanos knew that.

Who word crafted that? How many people were involved in that false statement?

A Reasonable Person after viewing the Video prepared by District Attorney Steve Wagstaffe will come to the conclusion that Chinedu V. Okobi died on El Camino Real, Millbrae California at the 9:10 mark 87 seconds before his body was sat up on his rear end with his legs straight out and his head slumped forward closing his airways. That is a full 9 minutes 40 seconds before CPR Chest Compressions were given while his hands were handcuffed behind his back. During this time there was a lot of talk and captions about checking his pulse but there is little evidence any of the 5 Sheriff Deputies or the Civilian CSO Joseph Gonzales did actually check his pulse.

SMCSO Deputy De Martini’s statement, He said he felt a pulse, but said due to the fact he had just been struggling with Okobi, he was NO LONGER Certain if he felt Okobi’s pulse or his own. That’s pretty honest. He also said “I kind of raised up his Head a little bit.

SMCSO Sergeant David Weidner “I Never take his pulse or anything like that.”

SMCSO Watt He was Unsure if decedent Okobi was breathing because he was not moving around to the extent Deputy Watt expected after the struggle. Regarding checking pulse.”Trying to reach” “I stopped trying to take a pulse because he was moving his head around.”

SMCSO Deputy Wang Did not check Okobi for a pulse.

SMCSO Lorenzatti “Put him in a seated position Paramedics arrived on the scene and she recalled seeing a paramedic determine Okobi did have a pulse.”  Deputy Lorenzatti did NOT check pulse. This statement makes it look like the paramedics were right there and started caring for Chinedu Okobi.  It was 10 minutes and 29 seconds of Okobi sitting with his head slumped down before paramedics at 17:59 Caption   “Paramedics try to awaken Okobi and attempt to locate a pulse.”

Jeffrey Martin the expert hired by Steve Wagstaffe and paid approx. $15,000 by Taxpayers stated 7:10 as the time Okobi was Handcuffed. Wagstaffe’s video doesn’t give a caption for time handcuffed. Weidner states Okobi was placed in seated position within 10 seconds of being handcuffed. That would be 7:20 Martin says 20 seconds so 7:30 Okobi in seated position. The video shows 10:27 Chinedu Okobi sat up on his rear end completely limp and unresponsive with head slumped forward which would have stopped his breathing if he was in fact breathing at that time. That is a 3 MINUTE difference between Expert and Deputy statements and the Video evidence.

SMCSO Press Release October 3, 2018

The deputy exited his vehicle to contact the suspect and the suspect immediately assaulted the deputy, that is the biggest lie of the two. a male adult who was running in and out of traffic on El Camino Real is the second.

Chinedu Okobi was not running in and out out traffic before Deputy Wang tried to herd him with his vehicle including driving the wrong way on ECR.

Supervisor Don Horsley while serving as Sheriff terminated the employment of a Correctional Officer for being dishonest, lying to a law enforcement officer during an investigation.

Don Horsley Terminates Employee for Dishonesty

The False San Mateo County Sheriff Office Press/News Release is the same thing. Everybody in the DA’s Office, County Counsel, and Sheriff’s Office who had access to the data knew the Press Release was Dishonest. There lies the problem for SMC residents/

PIO Rosemerry Blankswade and Sheriff Carlos G. Bolanos are responsible for this press release to be put out to the public.

District Attorney Steve Wagstaffe took 5 months to finally release a highly edited creation of video/some-audio including Captions he felt would be helpful in misleading the public to believe that Chinedu V. Okobi “He was still breathing when the Sheriff Deputies turned him over to the AMR people.” He takes it a step further and said it was several minutes after AMR had him. If several means 3 minutes that would be around the 21:00 in his video. Wagstaffe does not tell you what time in the video that transfer of responsibility occurred.

Wagstaffe also fails to identify CIVILIAN CSO Joseph Gonzales 6:26 mark who was physically involved in the takedown of Mr. Okobi. It was Illegal for him to be involved. “He had multiple red/brown stains located on his person from the altercation.”

You can see him in action at the 7:18 mark when several deputies get pepper sprayed. Wagstaffe’s Caption at 7:22 mark “A deputy attempts to subdue Okobi with pepper spray but mistakenly hits his fellow deputies and sergeant.” Joesph Gonzales is not a San Mateo County Sheriff Deputy, Wagstaffe knows that. He doesn’t identify the deputy, Why? Wagstaffe’s Expert Jeffrey Martin says Deputy Wang did it. There are 5 deputies and 1 CSO that makes 6 people involved. Three of them got sprayed, that leaves two deputies, Deputy DeMartini’s statement rules him out. The person who did the spraying said “I did, I did that.” Jamie Draper has access to voice recognition software it should be simple to identify who said those words. It’s one of two people Deputy Wang  or CSO Civilian Gonzales.

Wagstaffe & Bolanos only identify the 5 deputies Why? The sixth Sheriff Employee CSO Joseph Gonzales is a civilian that’s why.

Wagstaffe fails to put a caption at the 10:57 mark. Deputy DeMartini Tampering with Evidence

Partial Video of March 1, 2019 Press Conference

District Attorney Steve Wagstaffe confirms Chinedu Okobi’s Death was a Homicide at 47:30 mark. How does he explain no criminal charges?

I attended the San Mateo County District Attorney’s Press Conference on March 1, 2019. At the -12:02 mark I asked Steve Wagstaffe “After Mr. Okobi stopped breathing, By putting him in a seated position did his head not go forward and stop his breathing?”

Steve Wagstaffe responded “It did not.” “The belief was not.” “That did not occur.” Because they continued to check for the breathing.

“But he was breathing and he had a pulse at that time.”

“He actually uttered some words.” Really? What were the uttered words, who heard them, and what time on the video? No caption for this important assertion.

The Video Wagstaffe produced shows otherwise at 10:27 mark.

A thought for the readers, Steve Wagstaffe and his TEAM and Sheriff Carlos Bolanos have had all of the data for 5 months. It was withheld from reporters and the public for 5 months.

Effective May 1, 2019 ALL E-MAILS WILL BE DELETED THAT ARE 90 DAYS OLD AND OLDER.

Welcome to San Mateo County.

14:30 mark, Steve Wagstaffe says “For True Independence” “I understand peoples perception.”

Below are e-mails of back and forth between San Mateo County Sheriff and District Attorney on the very first day the public was learning about our two top Sheriffs being caught and detained/transported by the Las Vegas Metro Police/FBI as customers of Human Trafficked Sex Slaves including a minor. You will see the unhealthy support and the destain for the media.

Carlos is Carlos G. Bolanos who was Illegally Appointed to Sheriff July 12, 2016 by the Board of Supervisors.

Every time I see San Mateo County District Attorney Steve Wagstaffe talk to people of color, I think there should be a warning, He is a racist and a liar according to these Judges. The 5 County Supervisors and their Staff all know this.

IV. Conclusion

Taken as a whole, the record compels a finding that the prosecutor’s non-race based reasons for peremptorily striking M.C. were pretexts.   The fact that the prosecutor peremptorily struck the only other African-American juror in the jury pool and provided at least two implausible reasons for that challenge reinforces this conclusion.   We therefore hold that both the California Court of Appeal and the district court clearly erred when they found that Ali failed to establish purposeful discrimination.   We further hold that, in light of the overwhelming evidence indicating that the prosecutor in Ali’s case acted with discriminatory intent when he struck M.C., the California appellate court’s finding to the contrary was an unreasonable determination of the facts in light of the evidence presented in the state court proceedings.   See 28 U.S.C. § 2254(d)(2).   We therefore reverse the judgment of the district court and remand with directions to issue a conditional writ of habeas corpus requiring Ali’s release from custody, unless the State elects to retry Ali within a reasonable time to be determined by the district court.

Real Estate Investor Clyde Berg Supports Silicon Valley Journalism & Media Projects

Handshake Deal Brings Investigative Reporting to Silicon Valley’s Family Courts

CUPERTINO, CA—In a signature handshake deal, driven in part by Santa Clara County’s District Attorney Jeff Rosen’s recent refusal to prosecute another rape case, California real estate investor Clyde Berg has lent support to Bassi Productions for a collaborative project that strives to infuse substantial funding and investment to journalism, local investigative reporting and production projects that seek to bring media attention to Silicon Valley’s most shocking divorce and custody cases.

Historically, the wealth of Clyde Berg, and his activist billionaire brother Carl Berg, has attracted some of Silicon Valley’s most nefarious criminals and scam artists, yet Clyde Berg contends what attorney Bradford Baugh did while representing his former wife in a divorce case was the most elaborate legal scam of all.

As part of an alleged scam, Bradford Baugh partnered with fellow divorce lawyer Sharon Roper, who drafted a bogus post-nuptial agreement that was later determined to have been forged a year before Berg’s wife filed for divorce and made false allegations of sexual assault and domestic violence. Had Berg not challenged the forged agreement and false sexual assault claims during a divorce and related civil case, Ellena may have succeeded in fraudulently obtaining $10 million dollars from Berg’s estate. Ultimately, Clyde was exonerated of all charges and obtained a rarely issued formal “finding of factual innocence”, meaning the crimes Ellena had alleged, and garnered media attention from, never happened, and Clyde, at 73 years of age, should never have been criminally prosecuted based on false claims.

Susan Bassi, a local publisher and court watchdog who experienced her own seven-year divorce case in Santa Clara County, met Clyde Berg on social media after she had facilitated bringing national media attention to the domestic violence and custody case involving Kendra Scott and former San Francisco 49er Ray McDonald. Bassi was especially struck by Berg’s compassion to believe women like Kendra and Neha Rastogi, a former Apple manager who suffered years of abuse at the hands of her powerful immigrant CEO husband, Abhishek Gattani during their 10-year marriage.

Bassi and Berg are united in their criticism of DA Jeff Rosen. Bassi has publicly argued that Rosen has failed victims and wasted taxpayer money by maliciously prosecuting men like Berg, while giving men including McDonald and Gattani a free pass.

For the past five years, Bassi has been pushing local and national news outlets to cover family court cases, where court files are fraught with horror stories that include shocking details involving domestic violence, tax evasion, sexual assault, child abuse, rape, and fraud , all of which are typically ignored by law enforcement agencies and judges.

Mainstream media outlets historically have steered clear of investigating divorce and family court scandals, as it can be virtually impossible to sort out the “he said, she said” allegations that characterize these cases. The Berg-Bassi collaboration will seek to provide support for local reporting and production projects with added support requested from the 49ers, the Oakland A’s as well as tech and social media companies including; Apple, Google, 23andMe, Yahoo, LinkedIn, Oracle, Facebook, and Netflix where employees, investors and founders have been personally impacted by unethical private and government lawyers seeking to misuse the courts and incite conflict in families for profit.

“We live in Silicon Valley where stories arising from family courts should fill local newspapers and provide production content to an area quickly becoming known as Hollywood North. Silicon Valley has the money, drive and technology to support journalism and investigative reporting to watchdog elected officials and court systems. Justice is never served when the media isn’t watching, ” Bassi stated as the collaborative project was announced.

Berg’s support, combined with the support of other tech and social media companies, will allow Bassi Productions to direct funding to journalism projects, social media storytelling and non-profit organizations committed to social justice and bringing much needed transparency to California’s family courts and law enforcement agencies dealing with intimate partner violence, sexual assault and false claims made during divorce and custody cases.
