SMC Hon. Judge Joseph Scott ruling on Miranda to be appealed.

By Michael G. Stogner

Juan P. Lopez

Yesterday in the x San Mateo County Sheriff Deputy Juan P. Lopez case Hon. Judge Joseph Scott ruled that San Mateo County District Attorney Inspector Jordan Boyd did not violate Deputy Lopez’s Miranda Rights even though he clearly asked to speak with his attorney twice. As soon as he finished stating his ruling Defense attorney Maria Belyi and Tony Serra respectfully informed the court that they would be appealing his ruling as early as that afternoon.

The Juan P. Lopez case all started 6.5 years ago with San Mateo County Sheriff Lt. Gilbert Armando and Jordon Boyd deciding on his own to start a criminal investigation, He claims nobody asked him. Wait till William Massey takes the witness stand. Massey is Boyd’s Boss.

This is SMC’s Collateral Consequences Case.

Showboater Supervisor David Canepa

By Michael G. Stogner

Recognizing a photo and public speaking opportunity is David Canepa’s speciality. Yesterday he again finds himself in another Supervisors district saying nice big words he has no influence over. Here is what he said yesterday “We will not tolerate hate in San Mateo County,” said Canepa. That should have always been true in SMC

He is in the company of Sheriff Carlos G. Bolanos and District Attorney Steve Wagstaffe.

Has Supervisor David Canepa watched the video created by Carlos Bolanos and Steve Wagstaffe and made public of Chinedu V. Okobi’s Homicide by SIX San Mateo County Sheriff Employees in Millbrae October 3, 2018. I have asked him he has not responded. Has he made sure the Sgt Zaidi was criminally charged for filing a false police report in that investigation?

Has Supervisor David Canepa made any public comment when Barbara Bonilla was first removed from her office as Executive Director of the Sheriff Activities League. Barbara Bonilla worked for Carlos G. Bolanos back at Redwood City Police Department in the early 2000’s and she was his campaign manager in 2018. She was finally criminally charged by the Attorney General’s Office after investigating her for Embezzlement and Money Laundering.

Has Supervisor David Canepa made any public comment about the Homicide of Sandra Lee Harmon by one and possibly two San Mateo County Sheriff Deputies in Half Moon Bay on May 5, 2021. The City requested the A.G. Criminally Investigate Sheriff Bolanos and District Attorney for there many false statements after the fact. No evidence of a shoot out, Tampering with Evidence the moving of 3 shell cases. The refusing to provide the Axon Log Records which would verify the statements by both that Deputy Dominguez turned off his Body Worn Camera before he shot an unarmed woman in the back while her hands were above her head. Also it looks like he fired first.

Has Supervisor David Canepa ever done anything to make sure Sheriff Carlos G. Bolanos and District Attorney Steve Wagstaffe would never use their authority to cause harm to a fellow Law Enforcement Officer like x San Mateo County Sheriff Deputy Juan P. Lopez. One of the many false charges that they held a Press conference for was Smuggling a cell phone and Drugs to a Hells Angel Gang member in Maguire jail. What did he say when those charges were simply dismissed 2.5 years later? Nothing

What did Supervisor David Canepa do when he learned about that, The Sheriff Office and the District Attorney’s Office used as a WEAPON to cause COLLATERAL CONSEQUENCES to a Sheriff Deputy? Nothing

Has he listened in to any of the recent Juan P. Lopez Court Hearings remember 6.5 years and counting?

He can today 9:30 AM 1-206-279-9591 code 631595

Sheriff Carlos G. Bolanos on Oversight System.

By Michael G. Stogner

CarlosG.Bolanos

Sheriff Carlos G. Bolanos

San Mateo County Sheriff Carlos G. Bolanos told the City of San Carlos Leaders “He could not recall an issue justifying spending money on an oversight system.”

Nobody is asking for a System. Carlos G. Bolanos has a history of misleading the public.

Here is just a short list of ISSUES that come to mind.

Sandra Harmon May 05, 2020 Killed by Sheriff Deputies, Deputy Dominguez firing 5 shots at Unarmed with Hands Up above her head. He Bolanos claims she fired her 2 shot shotgun at Dominguez while he was taking cover behind his patrol car which was parked sideways. Not a mark or scratch on the patrol car of the Deputy. He claims Deputy Dominguez did not turn on his Body Worn Camera and that is why there is NO EVIDENCE provided to prove Sandra Harmon fired ANY shots.

At the 8:02-8:08 mark you will see Sandra Harmon Unarmed with hands above her head and you will hear 5 shots being fired at her.

Sheriff Carlos G. Bolanos’s video

February 10, 2020 SAL Executive Director Barbara Bonilla was escorted out of her office and is being investigated for embezzlement. She was Sheriff Bolanos’s Campaign Manager in the 2018 election. She has resigned from the Sheriff’s office since Why? She she hasn’t been charged with any crime. She has been removed from State and National PAL Boards.

September 14, 2019 Redwood City Police arrested SMCSO Sergeant Luis Aquino for DUI and refusing to take both blood and breath test. Sheriff Bolanos and David Silberman refused to provide his Booking photo. San Carlos: An additional $50,000 was also approved for DUI services.

October 3, 2018 Chinedu V. Okobi Homicide in Custody just like George Floyd, No 911 Call, just a Moorehouse Graduate and father walking on the sidewalk in the middle of the day, No crime committed before Deputy Wang got attracted to him a large Black Man he was dead minutes later.

December 31, 2018 San Mateo County Deputy Heather Diaz Coroner “I have determined the manner of Death to be Homicide.”

HOMICIDE PROTOCOL* 36 year old male involved in a physical altercation with San Mateo County Sheriff’s deputies. March 1, 2019 District Attorney Steve Wagstaffe confirmed it was a Homicide at the very end of his Press Conference where he announced no criminal charges would be filed. KQED, CBS5, and San Mateo County News.com all reported Homicide.

One ISSUE was the many False Statements provided to the Public by Sheriff Carlos G. Bolanos per his News Releases dated October 3, 2018 and March 1, 2019.

June 3, 2014 Yanira Serrano killed by Deputy within 20 seconds of getting out of his patrol car. It was a non emergency 911 call for medical assistance.

2014 Lets not forget what Carlos G. Bolanos and many others have done to destroy former Sherif Deputy Juan P. Lopez since he filed to run for Sheriff of San Mateo County. Smuggling a Cellphone and Drugs to a gang member in Jail. Sure he did, 100% False Charges.

2009/10 San Mateo County Sheriff Male staff 46 of them sharing Porn and Rape video on County Computers.

April 21, 2007 Operation Dollhouse, Las Vegas Nevada

Regarding Citizen Oversight and or an Audit of his work

Sheriff Bolanos said he was open to but felt removed accountability from leaders of organizations. I have no idea what that means

“I believe they’re dysfunctional primarily because you have people who are not experts in certain fields making determination on what is appropriate or not,”

“With me as an elected official the voters have the greatest civilian oversight and can replace me with someone else.”

How would the voters ever know what he is doing or how he is doing it without an Audit.

You can’t possibly manage what you don’t measure.

San Mateo County’s Above the Law Gang.

By Michael G. Stogner

San Mateo County Sheriff Deputy Juan P. Lopez was ordered to stay home when he was the subject of an Internal Affairs Investigation. That is exactly what happens.

What about SMCSO Sergeant Luis Dejesus Aquino, and SMCDA Inspectors William Massey & John Warren? Were they ordered to stay home?

Hello Rosemerry,

As you know it’s important for the Public’s Trust that Nobody is above the law.

Was SMCSO Sergeant Lou Aquino ever placed on Administrative Leave after his September 14, 2019 DUI Arrest.

Who at the Sheriff’s Office conducted the Internal Affairs Investigation that you told the PADP was being conducted? Is it completed?

Please provide San Mateo County News.com with the Booking Photo from the Sheriff’s office as you know I have asked for this several times.

Did DMV suspend his California Drivers License yes or no?

Thank You

    Michael:

I hope you also had a good holiday season.

As you may know by now, yesterday the court ordered the Citizen’s Complaint and any information related to it including the DA’s internal investigation, sealed from disclosure as a confidential record. Therefore, the County is not at liberty to discuss the investigation or answer any questions about it because to do so would violate the court order.

    Best,

    John

“Unqualified trust relationship with this partner.” Hon. Judge Lisa Novak

By Michael G. Stogner

CarlosG.Bolanos

Sheriff Carlos G. Bolanos

In a response to the Commission on Judicial Performance .

The Commission on Judicial Performance, established in 1960, is the independent state agency responsible for investigating complaints of judicial misconduct and judicial incapacity and for disciplining judges, pursuant to article VI, section 18 of the California Constitution.

Somebody filed a complaint against Judge Novak because she notified all the Judges present at the June 20, 2017 Judges Meeting, She had made a finding that SMCSO Sergeant Michael E. Otte Perjured Himself in her courtroom.

The person or persons who filed the complaint was not concerned at all by the fact that a SMC Sheriff Sergeant would lie under oath in her court, the person and the CJP was only concerned that she informed all the Judges who attended.

She noted the close relationship between the Sheriffs Office and the Court and cited the need to have an unqualified trust relationship with this partner.

Lets look at this unqualified trust relationship with the Sheriff’s Office under the leadership of Carlos G. Bolanos.

In-Custody Homicide of Chinedu Okobi three False News Releases. Omitting 6th Sheriff Employee for starters.

San Mateo County Sheriff Sergeant Lou Aquino DUI arrested by RWCPD September 14, 2019 Sheriff Bolanos refuses to release the Booking Photo. Why?

San Mateo County former Sheriff Deputy Juan P. Lopez criminal case going for more than 5 years with the sole purpose to cause harm to him mentally and financially. The public might recall the big Press Conference claiming Nobody is above the law in San Mateo County and Charging Deputy Lopez with Smuggling a Cellphone and Drugs to a Hells Angel member in Jail. Sheriff Carlos Bolanos knew there was No Evidence to support those charges.

These are just three current examples unqualified trust relationship with the Sheriff’s Office under the leadership of Sheriff Carlos G. Bolanos.

An older example when Carlos G. Bolanos was Undersheriff 2010 the Brave Female Deputy reporting the 46 San Mateo County Sheriff Male Employees receiving and sharing Porn and Rape Video on County Computers.

It is my experience that Judges in San Mateo County have allowed Sheriff Employees and District Attorney Employees and County Counsel Employees to lie/file false instruments and give False Testimony on a daily basis, this is the Norm it shouldn’t be.

I say you can’t possibly manage what you don’t measure.

Lets find out exactly what happened after Hon. Judge Lisa Novak made a finding that SMCSO Sergeant Michael E. Otte Perjured Himself in her courtroom.

The San Mateo County District Attorney’s Office is not to be Political or used as a Weapon. Tell that to San Mateo County District Attorney Senior Inspector William Massey.

A reasonable person would think that the Five Supervisors (Carole Groom, Don Horsley, Warren Slocum, Dave Pine, David Canepa) of San Mateo County would do everything in their power to assure the PUBLIC that this could NEVER happen on their watch.

A reasonable person would think that San Mateo County Counsel John Beiers and David Silberman would do everything in their power to assure the PUBLIC that this could NEVER happen on their watch.

A reasonable person would think that San Mateo County Manager Mike Callagy would do everything in his power to assure the PUBLIC that this could NEVER happen on his watch.

I know for a fact that all of the above mentioned San Mateo County Leaders are very aware because for the last 20 years I have been keeping them informed. Public comments at the Board of Supervisor meetings, sending them copies of my articles from SMCN.com. This is a Five year case finally soon to be heard by a Jury.

Case dismissed against former deputy

21253_main

Juan P. Lopez

Juan Lopez

The case against a former San Mateo County sheriff’s deputy being charged for allegedly helping to smuggle cellphones and prescription drugs into county jail was dismissed Friday after a judge ruled evidence that could have showed he did not commit the crime should have been presented to a criminal grand jury.

But District Attorney Steve Wagstaffe said Judge Donald Ayoob is imposing a burden on the prosecution that the law does not require. He said prosecutors informed grand jury members of letters an inmate wrote recanting his testimony connecting Juan Pablo Lopez, 54, with a cellphone involved in the case, and were not required to present them unless the jury asked to see them. He disagreed with Judge Donald Ayoob’s ruling that prosecutors had a duty to present the letters, and said prosecutors may consider refiling the case or appealing the decision.

“We feel the judge made a very serious error in his ruling,” he said. “We will assess it the coming days.”

On Dec. 16, 2015, Lopez and two county jail correctional officers, George Ismael and Michael Del Carlo, were accused of providing cellphones and drugs to inmate Dionicio Rafael Lopez Jr., who was also indicted along with Leticia Lopez, Amanda Lopez and Roxanne Ingebretsen, according to prosecutors.

On Nov. 17, the case against Del Carlo was dismissed after Ayoob granted his motion to dismiss over strenuous prosecution objection, according to prosecutors.

Once a write-in candidate for county sheriff, Lopez is also being accused of embezzlement, perjury and election fraud based on allegations he used donations from his campaign for his own personal use and lied about his city of residence, according to prosecutors.

Lopez listed his residence as being in Redwood City but allegedly was living in Newark when he filed to run for sheriff in 2014. He is also being accused of misrepresenting his address on a real estate loan, according to prosecutors.

Lopez will next appear in court Jan. 25 to set a new jury trial date for the embezzlement, perjury and election fraud charges and is out of custody on a $170,000 bail bond, according to prosecutors.

Let me get this straight. Wagstaffe’s little pal Sheriff Munks and Under-sheriff Carlos Bolanos are caught going into a house of underaged trafficked prostitution in Las Vegas in 2007, for their own recreation. Wagstaffe defends them to the hilt and says they did nothing wrong. He sweeps it under the rug.

But when a clean deputy decides to run against the corruption of the San Mateo Sheriff, Wagstaffe and Munks punish him by cooking up suspect charges that don’t hold up light when examined AND hold a big press conference to announce it? Lopez wasn’t the one caught going into a place with underaged trafficked girls. The fact that someone dared to challenge the corrupt sheriff angered Wagstaffe and Munks. Something is rotten in San Mateo County

The District Attorney’s Office withheld the letters from the Grand Jury, and offered a not so truthful representation of what the Jailhouse snitch actually said. To this day there has been ZERO evidence that Sheriff Deputy Juan P. Lopez was connected to the cellphone/s and drugs, and the DA’s Office has always known that fact. Disgusting behavior.

Michael Stogner

It’s about time, After over 3 years of the District Attorney’s lies and false charges against Former Sheriff Deputy Juan P. Lopez and others a Judge finally got to see what the DA’s office has done. It shouldn’t take over 3 years to present your side of a case. This dismissal makes 4 for 4 defendants charges dismissed.

Mr. Stogner:

I have looked into this matter and have confirmed that Inspector Boyd did indeed conduct an interview with Irma Lopez on December 8, 2014. It was recorded, and a report was written regarding that conversation. I have personally read the report and listened to that eleven minute interview. Perhaps Mr. Hanlon can confirm the existence of this evidence for you, as he was provided with discovery of that phone call well before the preliminary hearing.

Once you have verified my information, please advise me if you wish to continue with your complaint about Inspector Boyd.

Sincerely,

Many of my family and friends know that I have been doing my best to eliminate Prosecutorial Misconduct in San Mateo County for the last 16 years. Here is just one example. It is also a perfect PC115 (A) Felony filing a false statement to a Judge to get a warrant.

Preliminary Hearing 3/29/2016

Hon. Judge Lisa Novak

Stuart Hanlon attorney for Juan P. Lopez asking San Mateo County District Attorney Inspector Jordan Boyd who is on the witness stand under oath.

“You testified about taking a statement from Irma Lopez, Juan Lopez’s sister, correct?” Jordan Boyd answered Correct

Where was the statement taken? Was it on the phone? In person?

Jordan Boyd answered “It was on the telephone.

What day was it taken?

Jordan Boyd answered “I don’t recall the date, I have to check my report.”

You have no report of this interview you simply mention it in a Search Warrant Affidavit.

“I have no reports of an interview with Irma Lopez. I only have a statement by you and an affidavit for a search warrant or arrest warrant, I’m not sure which saying, you talked to her. I’m asking you when did you talk to her?”

Jordan Boyd answered “I don’t have that.”

SMC Dishonest Search Warrant, Steve Wagstaffe is going after Jody Loren Williams. Why now?

Case Number 18-SM-009489-A

Has San Mateo County District Attorney’s Office ever been used as a weapon before? Yes of course it has, John Johns R.I.P. and Sheriff Deputy Juan P. Lopez cases are perfect examples, and now, Jody L. Williams. Secret/Hidden Search Warrants

How many Misdemeanor cases from another State with Sealed Police Report and Search Warrant does the DA do per year average?

Jody Loren Williams recently discovered she missed a court appearance and had a warrant for her arrest. Both were News to her and the District Attorney wanted it that way. The DA sent the notice to appear to an address she would not get it, and they sent it by regular mail with no signature required to prove she received notice.

This behavior should come as no surprise to San Mateo County residents Pacifica resident Therese Dyer has notified the San Mateo County Supervisors for over a decade of the Corrupt DA’s Office, The Supervisors refuse to Audit which would stop the corruption on the spot.

4/25/2007 when District Attorney James P. Fox and Chief Deputy District Attorney Steve Wagstaffe sent these 2 e-mails which demonstrate the small but very powerful group of “Above the Law” aka “Those Who Matter.” Organized Crime Element.

emails&literature

Steve Wagstaffe said “remember it will be yesterday’s news and irrelevant by tomorrow”

Now here we are 11 years later and Mr. Wagstaffe charges Jody Williams in San Mateo County Court. Who is Jody Williams? On April 21, 2007 she is the woman who reported that the 25 women and one minor who were Human Trafficked Sex Slaves in Operation Dollhouse did not make it to the Salvation Army Safe House that night where they were to be for 72 hours of safety. How would she know that, She was there to meet them.

Jody Williams is a key witness to what really happened the night of April 21, 2007, and she has confirmed what San Mateo County Sheriff Deputy Heinz Puschendorf has stated that Munks and Bolanos were transported from 3474 Eldon Street that night. Here is a quote from Jody Williams on the subject:

“Clearly, someone in ICE, Homeland Security and the trafficking task force had to be involved in this network for it to work. And clearly someone was because not only were the two sheriffs who were on site, and then released, despite the mandatory immigration laws, despite the fact drugs were seized, and also despite a juvenile and a pregnant woman being caught on sight – and frankly, if I hadn’t been chased off the property, discounted, ignored, smeared, and shut out of the process – we could have ended the whole matter and exoronerated both Greg Munks and Carlos Bolanos in one afternoon because I would have asked for either their body camfootage, or I would have asked to see their drivers’ footage.”

Jody Williams is right, FBI’s video, Limo Video. Video from LVMPD Holding cell would solve all of those questions.

San Mateo County’s Big Lie, the coverup of Munks and Bolanos at the expense of the victims and the residents of San Mateo County. Here is what they are accusing Jody Williams of:

Case Number 18-SM-009489-A Unauthorized Practice of Law

05/08/2018 BP6126(a) Misdemeanor: Unauthorized Practice of Law

08/13/2018 Notice to Appear deliberately mailed to an address where Jody would not receive it.

09/13/2018 Arrest Warrant Issued by Judge Robert Foiles for Failure to Appear and Bail set $2,500

10/02/2018 Declaration in Support of Criminal Complaint filed.

10/02/2018 Order to seal police report pursuant to PC 964

10/02/2018 Police Report Ordered Sealed

You will notice there is no mention of this Secret Search Warrant issued July 12, 2018 as noted in the above case.

Jody Williams Search Warrant

Jody L. Williams is an Advocate who was helping a Destroyed Father who just wants to get back with his children. The attorney representing his wife in a San Mateo County Family Law case was going to have none of that, and filed a criminal complaint against Jody Williams.

Steve-Wagstaffe

D.A. Steve Wagstaffe

The above Search Warrant is a Fraud. The District Attorney’s Office would have searched the Fathers e-mails to see the Illegal Crime Unauthorized Practice of Law evidence.

Instead they go after the key witness to Operation Dollhouse. Who would want to do that? Sheriff Carlos Bolanos, Steve Wagstaffe, Karen Guidotti, Morley Pitt, Albert Serrato, John Warren, just to name a few.

Jody Williams could really use your support at this time, Please consider donating to her for her legal funds that are now facing her, Think about it she lives in Las Vegas and has to commute to San Mateo County to defend herself. Thank You for reading.

Tony Serra to SMC Hon. Judge Mark Forcum. “Targeting” Deputy Juan P. Lopez

serraTony

“Targeting Juan P. Lopez” “Bad Faith” “Misuse of a Search Warrant.” “Using it as an Investigative Tool.” “You can’t use a Search Warrant for that.” “Therein lies the Bad Faith.”

October 17, 2018 Honorable Judge Mark Forcum thanked Tony Serra for his comments and ruled against him. He ruled that now SMCSO Lt. Andrew Armando did have probable cause to obtain the Search Warrant. He ignored the obvious (Perjury) lying to Hon. Judge George Miriam by then SMCSO Detective Andrew Armando.

Lt. Andrew Armando has not been investigated or charged by the San Mateo County District Attorney’s Office. Why?

They have know known of these allegations for almost 4 years. May 1, 2018 Tony Serra and Maria Belyi filed this motion, which clearly alleges perjury.

“The most suspicious call” Lt. Andrew Armando made this call himself. That didn’t bother the Honorable Judge Mark Forcum one bit.

Lopez Filing May 1, 2018

November 15, 2018 is the next Court Date for a Franks Hearing where finally SMCSO Lt. Andrew Armando will be on the witness stand under oath.

I have been reporting about the “Targeting” to cause financial harm to Sheriff Deputy Juan P. Lopez and anyone close to him for almost 4 years now. It was refreshing to hear his attorney mention that in court yesterday. One example is the motion above which Judge Mark Forcum has personally continued at least 4 times. That means Juan’s attorneys had to drive down from San Francisco 4 times wait for the case to be called to have Forcum say it’s continued. Attorney Stuart Hanlon Juan’s first law firm told a reporter his career could be impacted for discussing Juan’s case in the interview. Nobody asked, What the Hell did Stuart Hanlon mean? Think about it. He was just telling the truth. Attorneys can and do get blacklisted in San Mateo County Courts.

Why is this one motion so important to San Mateo County Officials? It proves that San Mateo County Sheriff Detectives and San Mateo County District Attorney Inspectors commit crimes to obtain Search Warrants like the 80 that were issued in the Sunny Day Murder cases alone. This one motion also shows that the Judges don’t care.

A recent DA Steve Wagstaffe quote: “I still believe that one of the key components of a good criminal justice system is faith that judges do the right thing,”

With Audits the residents don’t need to rely on faith.

SMCSO Lt. Andrew Armando is a Brady Officer
