Why both privacy and public safety matter with license plate reader data.

As the sheriff of San Mateo County, I am dedicated to protecting public safety and the privacy of our residents. In response to a recent opinion article on automated license plate reader (ALPR) technology, I wanted to provide our county’s residents with the facts about the technology and how the data is used, shared and retained by law enforcement.California law enforcement agencies are required to have and post ALPR usage and privacy policies to ensure that the collection, use, maintenance, sharing and dissemination of the information is consistent with respect for individuals’ privacy and civil liberties.Law enforcement agencies use ALPR technology to automate manual processes that help identify stolen vehicles, vehicles used by wanted suspects, vehicles used by registered sex offenders, locating missing persons and, more importantly, to investigate criminal activity more efficiently. ALPR technology takes photos of license plates in public view and runs the scanned images through a list of plates sought by law enforcement. The system collects the photo of the vehicle, license plate number and the location data. The system does not collect personal identifying information, such as birth dates, names or criminal history. My office’s ALPR data is retained for a maximum of one year unless the information is from an ALPR that has been deployed within an area wherein the local government has requested a shorter retention period.Our data is not shared with unvetted third-party organizations. Only law enforcement personnel with a need and right to know the information may have access to the data. On the topic of ALPR data sharing and immigration enforcement, we do not share any ALPR data with “ICE to track undocumented immigrants, who have committed no offense other than trying to make a life for themselves in California without documentation,” as stated in the guest perspective “Why license plate privacy matters” authored by state Sen. Scott Wiener, D-San Francisco, in the April 7 edition of the Daily Journal. ALPR databases in California may not be accessed for the sole purpose of immigration enforcement as required by the California Values Act. Misuse of data by law enforcement personnel may be cause for administrative, civil and criminal penalties. Currently, Senate Bill 210 seeks to limit the retention of ALPR records to 24 hours. This would not improve privacy, but it would limit our ability to investigate violent crimes, serial criminal activity and any other crime that takes more than 24 hours to identify suspects, locate witnesses and locate victims. If the bill were passed into law, it would reduce or eliminate our ability to solve some of our most serious criminal offenses. In one example of the use of ALPR data, a suspect in Daly City exposed himself as he attempted to grab a 12-year-old female victim, who was fortunately able to escape the assault. The victim provided Daly City Police Department with a description of the suspect and his vehicle. After reviewing thousands of ALPR images, they found a match. The system was then used to locate the vehicle in San Francisco. The suspect was ultimately arrested in San Francisco for the assault on the child and for being in violation his sex offender registration. Under SB 210, the evidence that led to the identification and arrest of the suspect would have been destroyed before investigators had the opportunity to review the images.In another example, a robbery occurred at a shopping center in the city of San Mateo and witnesses provided San Mateo Police Department with the suspects’ license plate number. The car was registered in Madera, California. Historical ALPR records provided information that the vehicle had been parked multiple times in Redwood City at the same location. Redwood City police responded to the vehicle’s historical parking location and found the car with the suspects inside. San Mateo police transported the victim to the location in Redwood City, where the suspects were positively identified, and the stolen property was recovered. Historical ALPR data quickly located suspects that had no fear of harming the public and brought them to justice. Under SB 210, the historical ALPR data would have been destroyed and law enforcement would have been looking for suspects 150 miles away.I am deeply committed to public safety and the protection of privacy. Some Residents of San Mateo County know that Carlos G. Bolanos was illegally appointed to the position of Sheriff on July 12, 2016 by the Supervisors of San Mateo County. It was not on the Agenda , Supervisor Don Horsley who was asked to recuse himself from that issue because his son is employed by the Sheriff’s Office lead the appointment through.

It’s telling that Sheriff Bolanos uses a minor female sexual assault victim as an example of why ALPR are great.

In one example of the use of ALPR data, a suspect in Daly City exposed himself as he attempted to grab a 12-year-old female victim, who was fortunately able to escape the assault. When on April 21, 2007 Carlos Bolanos was Detained in Las Vegas during the FBI Sting “Operation Dollhouse” He was caught inside the single family residence located at 3474 Eldon Street where a minor female was the victim of Human Trafficking of Sex Slaves.

I would tell you the name of the State of California’s Prosecutor if I knew it and I’m sure the person said it twice now but to be honest I could barley hear what they were saying, I had to listen by phone.

This case was investigated as an Embezzlement and Laundering case involving SAL FUNDS.

On February 10, 2020 Barbara Bonilla was escorted from her office of Executive Director of San Mateo County Sheriff Activities League (SAL). The SAL is a division of the Sheriff’s Office. At that time Barbara Bonilla was employed by the San Mateo County Sheriff’s Office.

Barbra Bonilla is well connected and well known for her Fund Raising abilities. She was also Sheriff Carlos G. Bolanos’s Campaign Manager for his 2018 run for Sheriff. April 2017 She donated $1,000 to his campaign. She was on the Boards of National PAL, California PAL, Redwood City Rotary, San Mateo County Parks and Rec Commission.

In May of 2020 she resigned from the Sheriff’s Office. Why? She was not charged with any crime and even if she was it doesn’t mean there is any evidence of a crime. The former Sheriff Deputy Juan P. Lopez case is a prefect example of that. “Smuggling a Cell Phone and Drugs to a Hells Angel Gang member in SMC Jail.” ZERO evidence to support those charges, they were dismissed.

San Mateo County District Attorney Steve Wagstaffe referred the Criminal Investigation to the State of California Attorney General because he was a member of the board of SAL. He wanted to avoid the Appearance of a Conflict of Interest. That is always a Good Idea when Public Trust is an issue.

San Mateo County Sheriff’Office should have done the same. Why would Sheriff Carlos G. Bolanos and all Sheriff Employees think they should Investigate Barbara Bonilla at all. If Steve Wagstaffe couldn’t Investigate it for an Appearance of a Conflict of Interest certainly the Sheriff’s Office had more of a Conflict of Interest.

The A.G.’s Office and the Sheriff’s Office worked together in the Criminal Investigation of Embezzlement & Laundering. The DOJ had expected to have Barbara Bonilla Arrested as early as April 2, 2020, but that arrest did not occur. Why?

Laundering Money, one of the easiest ways to accomplish this is Prepaid Gift Cash Cards you buy at many Stores. Did this element exist in the SAL Investigation? YES it did.

Sheriff Carlos G. Bolanos News Release December 4, 2020 Bonilla Arrest

The last sentence in the SMCSO News Release dated December 4, 2010 says: “this investigation is still underway and being handled by an outside agency.” It doesn’t identify that outside agency WHY?

When I asked SMCDA Steve Wagstaffe who’s Criminal Investigation was this he informed me it was the San Mateo County Sheriff’s Office.

It was charged by the Attorney General’s Office, so it would be described as a DOJ case.  I believe that is how it would be listed in statewide statistics, since I believe they list the prosecuting agency. But the investigating agency would be the Sheriff’s Office.

Is SMC Sheriff Carlos G. Bolanos Honest?

This should be the only subject that is Important for the City of Half Moon Bay Public Safety Subcommittee. The Sheriff is the Vendor of Law Enforcement.

Half Moon Bay City Manager Bob Nesbit and Deputy City Manager Matthew Chidester have shown consistently that they have no interest in the truth about Sandra Lee Harmon’s Homicide by San Mateo County Deputies on May 5, 2020 at 845 Main St. Half Moon Bay, California.

They both have been provided a tremendous amount of data by Citizens to know beyond a shadow of doubt that Sheriff Carlos G. Bolanos is dishonest and they both continue to mislead the subcommittee and the public.

Sheriff Carlos G. Bolanos told the public Sandra Lee Harmon was killed in a Shootout with two of his deputies. He said She fired first. His deputies have Body Worn Cameras and that shootout should be simple to verify right? Wrong the Sheriff casually says the one and only BWC that could verify the shootout was turned off at the time of the killing. Sheriff Bolanos knows Ms. Harmon was shot 3 times in the back all 3 shots were fatal, he omits that fact. He knows 3 of the 14 spent shell casings were moved and replaced in a location more consistent with the official narrative. He knows his deputy fire at Ms. Harmon while she was unarmed and her hands were above her head he fails to inform the public of that fact.

The Axon Log Records are the answer. San Mateo County Counsel Attorney David Silberman who’s daughter Sara is employed by Sheriff Bolanos has obstructed the release of the Axon Log Records multiple times. Why?

Retired Deputy Mark Melville is running for Sheriff of San Mateo County in 2022.

Candidate for San Mateo County Sheriff 2022 Mark Melville has stated “Absolutely he will release the Axon records as soon as he is Sheriff. He said the same thing about all Booking photos.

Bob Nesbit and Matthew Chidester have known this information for a long time and produced this meeting December 10, 2020. There is No Mention of Chinedu V. Okobi Homicide by San Mateo County Sheriff Employees on October 3, 2018 in Millbrae. Why? Chinedu was San Mateo County’s George Floyd, No 911 call, No crime being committed, Sheriff Bolanos Issued 2 False News Releases that remained on the County’s website for 5 months. That is almost identical to the Sandra L. Harmon Homicide.

NO Mention of the Axon Log Records. Why?

San Carlos New Police Chief SMCSO Captain Kristina Bell. Why?

Why would the City Manager Jeff Maltbie and the City Council think this is a good choice to lead the law enforcement of San Carlos by its vendor the San Mateo County Sheriff’s Office. They all know or should have known about the Special Treatment she received by the Redwood City Police Department when it received a 911 call for Domestic Violence at her Redwood City residence. No Arrest, No gun removed, No Police Report.

Any one of the City Leaders could have simply Googled her name Lt. Kristina Bell D.V. 911 and found out about that.

What is her position on Sheriff Carlos G. Bolanos releasing the AXON LOG RECORDS in the Half Moon Bay Homicide by Sheriff Deputies of Sandra Lee Harmon on May 5, 2020. The Sheriff’s Office said there was a Shoot Out and Ms. Harmon fired first, There is no Evidence of that, There is Evidence of three Spent Shell casings being moved at the crime scene.

What was her position on the Sheriff’s Office issuing 2 False News Releases on October 3, 2018 on the Homicide of Chinedu V. Okobi by Sheriff Deputies and one Sheriff Employee.

What is her position on the Sheriff’s Office issuing a News Release December 4, 2020 stating: On Friday, December 4, 2020, Bonilla was booked into the San Mateo County Jail on 7 counts of Grand Theft. Bail was set at $70,000. Checking with the Court Clerk on December 8, 2020 no record of her being arrested or in San Mateo County Jail on December 4, 2020. The DOJ Investigation was for Embezzlement and Laundering how did that turn into Grand theft?

What is her position on the Sheriff’s Office NOT RELEASING the Booking photo of Barbara Bonilla former Sheriff Activities League Executive Director, Former Sheriff Employee, and 2018 Campaign Manager for Sheriff Bolanos.

Why would Jeff Maltbie think this is a good fit for San Carlos?

Get on the Special Elite TEAM, become one of “Those Who Matter” Special Treatment on a 911 Domestic Violence Call is about is about as Elite as you can get. San Mateo County Domestic Violence Protocol was Violated on that call. Many on the Those Who Matter team knew about it and kept their mouths shut.

The Public understands that people are just human beings and there a bad apples everywhere. When one is discovered we the people expect those who know to speak up, Notify the Public Immediately. San Mateo County Sheriff Activity League of all the organizations involving Children, Volunteers, Donors and Sheriff Deputies should have been the first group of people to inform the Public about this Embezzlement. All 7 Print Media in SMC should have had front page stories about this on February 10, 2020. None of them did. ClimateRWC should have had the story first Adam Alberti the Editor is on SAL Board, he knew.

Update December 11, 2020: It turns out there is NO EVIDENCE to support Sheriff Carlos G. Bolanos News Release of December 4, 2020 “On Friday, December 4, 2020, Bonilla was booked into the San Mateo County Jail on 7 counts of Grand Theft. Bail was set at $70,000.” No booking photo, and no record of her being in Jail or Court until December 9, 2020.

This case is being Prosecuted by the State of California A.G. Office.

Barbara Bonilla the former Campaign Manager for Sheriff Carlos G. Bolanos in 2018, and a former San Mateo County Sheriff Employee until she resigned while being investigated by the State of California Department of Justice since February 10, 2020 when she was escorted from the SAL offices in Redwood City. She was also on the San Mateo County Parks and Recreation Commission, as well as on the Boards for State and Federal Police Activity Leagues (PAL) Associations.

She has been charged with 7 felony counts after being Independently Investigated by the A.G.’s Office for Embezzlement and Laundering. San Mateo County District Attorney Steve Wagstaffe had to refer the Investigation to the A.G. because he is also on the Sheriff Activity League Board. Her bail was set at $70,000 she should be out by now.

Sandra L. Harmon, Andres Gaurdado both Shot in Back with Hands up.

What did Sandra Lee Harmon R.I.P. and Andres Gaurdado R.I.P. have in common. They were both killed by Sheriff Deputies in their counties. Sandra was shot 3 times in the back and Andres was shot 5 times in the back all 8 shots were FATAL. Both Sandra and Andres had their Hands Up above their Heads when they were shot.

Who doesn’t want to get to the truth here? The list is long.

In San Mateo Mateo County the short list is Sheriff Carlos G. Bolanos, District Attorney Steve Wagstaffe, Coroner Robert Foucrault, County Counsel John Beiers, Charles Joseph, and David Silberman who’s daughter Sara works for the Sheriff.

The issue is simple Sheriff Carlos G. Bolanos and others want the public to believe them when they tell lies. I want to believe the highest ranking Law Enforcement Officials in San Mateo County. We all want to believe the highest ranking Law Enforcement Officials in SMC.

They told us there was a shootout, Sandra fired first, the scared for his life deputy returned fire and she died. No mention she was unarmed, she had her hands up above her head with her back to Deputy Dominguez who all by himself fired 11 shots at her. No mention that 3 of the 14 shell casings were moved (Evidence Tampering) That’s a bad thing.

They told us it’s unfortunate but the scared for his life deputy didn’t turn his AXON BODY CAMERA on at the time of the killing.

The AXON LOG RECORDS of the Sandra Lee Harmon Homicide by San Mateo County Sheriff Deputies on May 5, 2020 in Half Moon Bay belong to the Public. The Public paid for them.

Body Worn Cameras are for the Protection of both Law Enforcement Officers as well as the Public. They provide truth of what really happened that night in the parking lot behind the Pasta Moon.

San Mateo County Counsel Attorney David Silberman has a long history of representing Sheriff Carlos G. Bolanos interests. Look what he did to former Sheriff Deputy Juan P. Lopez, he protected Sgt. Jason Peardon, or for former San Mateo County Sheriff Sergeant Mike Otte who not only lied, but committed Perjury in Hon. Judge Lisa Novak Court.

David Silberman is standing in the way of the Public verifying what they already suspect. Why?

Mark Melville Sheriff Candidate for 2022 less than 2 years from now has already said several times that he will release to the public the AXON LOG RECORDS that David Silberman is so adamant the Public will never see.

The City of Half Moon Bay should sue San Mateo County for the AXON LOG RECORDS today. They should not hesitate, what the council has done so far with asking the A.G. to Investigate the Sandra Lee Harmon Homicide is Historical, and they have requested from Sheriff Carlos G. Bolanos the AXON LOG RECORDS, that Mark Melville has said he will gladly provide to them when he becomes Sheriff of San Mateo County.

Citizen David Eblovi has informed the City of Half Moon Bay that he will sue the County for the AXON LOG RECORDS if he has to. Don’t make a Citizen do the work the City should do.

After the Public gets the AXON LOG RECORDS, and if it turns out the story provided by the SMC Government is false, David Silberman should be fired.

I can’t think of a more Important Story to write about on this day. Sure there are many other subjects like who is going to be the President of the United States of America. Let me tell you why I choose to write about former Deputy Juan P. Lopez on this day.

For me there is no more Important subject in San Mateo County than Corruption, and Abuse of Authority and Office.

I was on the phone with Juan Lopez when he was Arrested with guns to his head Six Years ago. That’s right I said Six Years ago.

Zain Jaffer

Zain Jaffer was Arrested for Attempted Murder and 6 Felonies. His Criminal case went through the San Mateo County Justice System in less than 9 months, and that included the Preliminary Hearing where all charges were approved by the Evidence and Testimony presented in Court. The Attempted Murder Charge was never charged by the District Attorney’s Office for some reason. Arrested October 15, 2017 DISMISSED July 2,2018.

I was hoping to hear from Zain Jaffer by now to share with him some cases of abuse by the District Attorney’s Office, Wrongfully Charged, Over Charged etc. As he claimed he was interested in helping now that he knew how it felt to be Wrongfully Charged. Per his prepared statement made July 2, 2018. Matthews Craves, Vincent Valencia, and of course Sheriff Deputy Juan P. Lopez are just a few of the many cases I can think of.

SMCSO Sergeant Michael Otte

San Mateo County Sheriff Sergeant Michael Otte who worked in Half Moon Bay Patrol Committed Perjury in Judge Lisa Novak’s Courtroom, He was on the Witness Stand under oath and he lied about videoing with his cellphone the arrest of a female Half Moon Bay Resident. The Judge, Sheriff Office, District Attorney’s Office, and David Silberman of the San Mateo Counsel were and still are aware of the PERJURY. Sergeant Michael Otte was never charged as a matter of fact Sheriff Carlos G. Bolanos not only allowed him to retire he gave him a retirement send off.

SMCSO Sergeant Lou Aguino

San Mateo County Sheriff Sergeant Louis Aquino Arrested by Redwood City Police Department for DUI. RWCPD has two Daily Activity Log records. His arrest was not made public. I was the first to report it.

Lt. Kristina Bell

San Mateo County Sheriff Lt. Kristina Bell 911 Domestic Violence Call to her residence by her partner, Redwood City Police at her home for hours. No ARREST made. Violation of San Mateo County Domestic Violence Policy. This response by RWCPD was not made public by the Police Department. I was the first to report it.

Barbara Bonilla

San Mateo County Sheriff Employee Barbara Bonilla who was the Executive Director of the Sheriff Activities League was escorted out of her office on Feb. 10, 2020, She has resigned from the Sheriff’s Office which is a Big Deal, She has been removed from the State PAL and Federal PAL Boards. The Sheriff’s Office and the Department of Justice have and are Investigating her for Embezzlement and Laundering of SAL Funds. She has not been charged with any crime yet. That’s 10 months of a “Those Who Matter” person not being charged by the DOJ. That is longer than the Zain Jaffer case from Arrest to DISSMISSAL. I was the first to report it.

The Department of Justice has received a letter from the City of Half Moon Bay requesting an Independent Criminal Investigation of the Sandra L. Harmon Homicide by Sheriff Deputies on May 5, 2020. This is a Historical Request by a City Council and it is Very Healthy to question Authority especially when so many False statements by Sheriff Carlos G. Bolanos and District Attorney Steve Wagstaffe were made to the Public.

San Mateo County Sheriff Sergeant Jason Peardon recently received a Distinguished Medal from Sheriff Carlos G. Bolanos. I have publicly stated and written about Sergeant Jason Peardon being a Brady Officer. The City of Belmont has finally provided the Court with the documents that Juan Lopez’s attorney had to sue them to provide. He will be on the Witness stand in the Juan P. Lopez Criminal Trial hopefully going before a JURY soon.

Some of you know I have been recommending an AUDIT of the Sheriff’s Office, District Attorney’s Office, Coroner’s Office, Private Defender Program etc. Audits are the easiest way to assure honesty in the performance of these offices San Mateo County.

Please follow the Deputy Sheriff Juan P. Lopez case. November 16, 2020 set for Jury Trial, I’ll update. Remember if they can do this to a Sheriff Deputy they can do this to YOU.
