Yesterday in San Mateo County Superior Court 2G Hon. Judge Joseph Scott discussed with SMCDDA Kimberley Perrotti and Defense attorneys Tony Serra and Maria Belyi how and when to proceed with the case that has so far taken over 6.5 years.

You will remember Sheriff Deputy Juan P. Lopez was arrested and charged with Smuggling a Cellphone and Drugs to a Hells Angel Gang Member Inmate at Maguire Jail way back in 2014.

A reasonable person would think and expect that the District Attorney of San Mateo County would not have charged Deputy Lopez with this crime unless they had evidence connecting him to this crime. Unfortunately for Deputy Lopez and many others in SMC that is not the case. Those charges were dismissed about FOUR years ago for ZERO evidence. Does the District Attorney of San Mateo County charge people for crimes he knows they have not committed? Yes

One of the subjects discussed yesterday was a witness for the Insurance company. You might ask What Insurance company and why? DDA Kimberly Perrotti is prosecuting Juan Lopez for Insurance Fraud, Under the Sink in the kitchen of his Redwood City Condo, Mold, Repairs etc.

This is where the Sheriff Deputy Juan P. Lopez case gets exciting. How does the District Attorneys Office get involved in an Insurance Fraud allegation and prosecute it. Did the Insurance Company file a complaint? No

For those of you following Juan’s case you will recall his personal vehicle was broken into at the Redwood City Condo a short time after he filed to run for Sheriff as a Write In Candidate back in 2014. He filed a report with the Sheriff’s Office, when asked if he had any idea who might have broken in his car and stole his laptop and personal documents (Insurance Claim) from the BACKPACK he said yes, the San Mateo County Sheriff Gang Task Force.

Here we are 6.5 years later Insurance Fraud case from the stolen items in the Backpack.

Has the San Mateo County Sheriff Gang Task Force ever broken into anybody car before? Yes

Has the District Attorney’s Office ever requested/ordered the SMCSOGTF to break into a car? Yes

Has that fact ever been testified to under oath in court before? Yes, The Sunny Day Murder Trials.

What happens when the District Attorney’s Office is used as a weapon? Absolutely Nothing.

The Lopez case should be contrasted to the Zain Jaffer, Vungle case.

Yesterday May 11, 2021 On a phone or Zoom appearance Hon. Judge Leland Davis III almost ordered x Sheriff Deputy Juan P. Lopez’s Attorneys Tony Serra & Maria Belyi to appear in person in Hon. Judge Joseph Scott’s Courtroom 2G today May 12, 2021.

San Mateo County DDA Kimberly Perrotti requested Judge Davis to order that after Maria Belyi explained she had scheduled another court appearance in a different county based on the Judges previous communication regarding the Medical Emergency of Hon. Judge Joseph Scott which was made public on April 1, 2021. Kimberly Perrotti knows that Judge Scott has not been back to his courtroom since April 1, 2021. That’s 43 days.

She knows he might not be back. It turns out He’s not.

Juan P. Lopez and his attorneys want the case to be heard by Hon. Judge Joseph Scott. They want him to be fully recovered from whatever the Medical Emergency was. Judge Davis had already explained that Judge Scott would NOT be available for any afternoon schedule, that means even if he did come back today he is only available from 9 AM-12 Noon each day.

The Juan P. Lopez started 6.5 years ago with SMCDA Supervisor of Inspectors William Massey trying to get the girlfriend of Candidate for Sheriff 2014 FIRED. He communicated at least twice with her Employer telling him to FIRE her.

The residents of San Mateo County will recall Deputy Lopez was arrested and Falsely charged with Smuggling a Cellphone and Drugs to a Hells Angel Gang Member. That is a Bad Thing. How many times does the District Attorney Falsely Charge someone in San Mateo County?

Hon. Judge Joseph Scott has been out of the Courtroom on a Medical Emergency since April 1, 2021.

Judge Davis should have an update in the morning.

A little background I call this the San Mateo County District Attorney Supervisor of the Inspectors William Massey case. Remember back to 2014 Sheriff Deputy Juan Lopez decided to offer the residents a choice for Sheriff in 2014.

William Massey did not like that idea and contacted the Employer of Juan’s finance and told him to Fire her. He refused do it so of course William Massey contacted him again with a more forceful demand to fire her.

DDA Kimberly Perrotti doesn’t want William Massey on the witness stand, I don’t blame her.

Anyhow it’s been 6.5 years, there is more than one way to destroy a person, when the D.A. Office is used as a weapon, False Charges like the Smuggling a Cell Phone and Drugs to an inmate. What happened to those charges? You would think your D.A. shouldn’t falsely charge Who’s going to know, or Who’s going to care?

What did the DSA do for Deputy Lopez? Nothing That’s strange.

Update Next Court Date: April 26, 2021 Time: 9:00 AM, We will see if Judge Scott will be the judge at that time.

Last Thursday April 1, 2021 retired San Mateo County Sheriff Deputy Juan P. Lopez’s case was moved from Courtroom 2H to 2 G just 10 minutes before it was to be heard. Judge Leland Davis III informed everyone that Hon. Judge Joseph Scott would not be there based on a Medical Emergency. That in itself is a pretty big deal one that would be on the front page of every Newspaper in San Mateo County even if it didn’t have anything to do with Deputy Sheriff Juan P. Lopez 6.5 year criminal case.

I hope the Medical Emergency has passed and everyone is ok, I have no idea who had the M.E. and Judge Davis III did not go into any detail.

What was to be heard last Thursday was a Motion to Quash a Subpoena involving San Mateo County District Attorney Steve Wagstaffe. Judge Scott had spent several hours getting up to speed on this issue.

For those who have been following the Deputy Juan P. Lopez story you will remember it began back in 2013 with SMCSO Lt. Armando, Sgt. Jason Peardon, and SMCDA Inspector Supervisor William Massey.

He was charged with Smuggling a Cellphone and Drugs to Hells Angels Gang Member in Maguire Jail. Embezzlement of Campaign Funds ($400K). What ever happened to those very public charges?

Defense attorneys for Juan Lopez are Tony Serra and Maria Belyi of San Francisco.

Yesterday in the x San Mateo County Sheriff Deputy Juan P. Lopez case Hon. Judge Joseph Scott ruled that San Mateo County District Attorney Inspector Jordan Boyd did not violate Deputy Lopez’s Miranda Rights even though he clearly asked to speak with his attorney twice. As soon as he finished stating his ruling Defense attorney Maria Belyi and Tony Serra respectfully informed the court that they would be appealing his ruling as early as that afternoon.

The Juan P. Lopez case all started 6.5 years ago with San Mateo County Sheriff Lt. Gilbert Armando and Jordon Boyd deciding on his own to start a criminal investigation, He claims nobody asked him. Wait till William Massey takes the witness stand. Massey is Boyd’s Boss.

This is SMC’s Collateral Consequences Case.

The entire Juan P. Lopez case is a Brady Issue. DDA Perrotti knows that.

DDA Kimberly Perrotti knows that and has alway known that and it has always been the Prosecutors responsibility and obligation to report BRADY Officers to the Defense she hasn’t she continues to protect them.

It started with San Mateo County Sheriff Deputy Gilbert Armando, who called a contraband phone himself but told the judge there was suspicious calls to that phone, who supposedly went to SMCDA Inspector Jordon Boyd for help after Boyd saw some data Armando shared with him he on his own started a Criminal Investigation in Juan P. Lopez.

Don’t forget all of the other charges Boyd is responsible for charging Juan P. Lopez the most Outrageous was Smuggling a Cellphone and Drugs to a Hells Angel Gang member in Maguire Jail.

This is exactly what happens when you have dishonest employees in San Mateo County.
