You don’t see that every day. Why would a defendant choose a Judge over 12 members of the public?
21-SF-014538-A | The People of the State of California vs. Aldon Jacarus Ramon Smith
Aldon Smith and his Defense attorney Josh Bentley have decided to have the Honorable Judge Leland Davis III to be the Judge and Jury for his DUI with serious injury case.
You will recall there was a lot of special treatment for this former NFL player that most San Mateo County Residents arrested for a DUI with serious bodily injury would NOT receive. This was reported to be his 5th DUI.
Update: 5:24PM Next Court Date is February 22, 2022 at 2PM Courtroom 8C

Wonderful photo by SMDJ of Aldon Smith, Definitely NOT a Booking Photo.
This is another exciting “Those Who Matter” case that the “Fixer” Joshua Bentley is quietly moving through the San Mateo County Court system.
You will recall Aldon Smith was arrested on December 6, 2021 by the California Highway Patrol at Farm Hill Blvd and 280 where he crashed into a Recology Truck injuring the driver. This is not the first time he has been arrested for DUI, It’s been reported he has been arrested 5 times for DUI.
Sheriff Carlos G. Bolanos has never released his Booking Photo or produced a Press Release of the December 6, 2021 arrest. Why?
Attorney Joshua Bentley is doing an Excellent job in trying to keep those four prior DUI’s out of this case.

Remember The San Mateo County Superior Court is encouraging the Public to attend the Courtrooms in Person. That change went into effect November 22, 2021. I wouldn’t recommend that.
Wonderful photo by SMDJ of Aldon Smith, Definitely NOT a Booking Photo.Sheriff Carlos G. BolanosD.A. Stephen M. Wagstaffe
This is a “Those who Matter” case, San Mateo County Sheriff Carlos G. Bolanos provided NO BOOKING PHOTO or PRESS/NEWS RELEASE of the arrest. Why?
That is the first Tell. The 2nd Tell is Defense Attorney Josh Bentley, The 3rd Tell District Attorney Steve Wagstaffe filed this case as a Misdemeanor 21-SM instead of a 21-SF which is a FELONY.
Smith declined a field sobriety test but later took a blood test that showed a blood-alcohol content of .288 percent, District Attorney Stephen Wagstaffe confirmed Thursday. Smith spent the night in jail. (source San Jose Mercury News Michael Nowels)
By declining a sobriety test at the scene, you forfeit California Drivers License for 1 year, unless you are one of the “Those Who Matter” TEAM.
If he was a BAC of .288 why is he charged with a 0.08?
San Mateo County has a First Chance DUI program for 1st time offenders. To my knowledge it does not have a 4th or 5th Chance DUI Program.
San Mateo County does have Defense Attorney Josh Bentley, Watch this case, it is going to be exciting.
TMZ was the first to report the arrest on December 6, 2021.
When I say watch this case, I mean show up to Court IN PERSON. A reasonable thinking person would know that there is a COVID-19 Pandemic in San Mateo County at this time. Listening by phone to the Court Hearings would be a lot safer you would think. Superior Court of California County of San Mateo Presiding Judge Leland Davis III thinks just the opposite. He cancelled Public Access by Telephone on November 22, 2021.
If you do attend the next Court date don’t be surprised if Aldon Smith and Josh Bentley appear remotely for safety reasons. Who would blame them. Stay Safe
Redwood City Manager Diaz, Melissa Stevenson, and the City Council should fix this. RWCPD Chief Mulholland is responsible for this. Two sets of Books.
Redwood City Police Chief Mulholland
This is not Breaking News, X Sheriff Deputy Colin T. Smith arrested twice by Redwood City Police Department in August & December 2013 same story. Not on the daily log for the public or reporters to be informed.
San Mateo County Sheriff Sergeant Aquino recent DUI arrest is just another example. His arrest September 14, 2019 is on one daily log, the one you have to go in person to the Redwood City Police Station and specifically ask for. The other daily log is on the internet for the public and reporters to view online much more convenient Sheriff Sergeant Luis Dejesus Aquino DUI arrest was not on that daily log list. I drove up from Monterey County to view the Special Daily Log and confirmed that San Mateo County Sheriff Deputy Luis Dejesus Aquino was arrested on September 14, 2019. He refused both blood and breath test, which should be a suspension of California Drivers License.
San Mateo County News.com was the first article on October 1, 2019 that was 2 weeks after the arrest. Most if not all San Mateo County Sheriff Employees knew he was arrested. Did any of them contact a reporter?
Sheriff Carlos G. Bolanos
I have asked Public Information Officer Rosemary Blankswade & Sheriff Carlos G. Bolanos to provide the Booking Photo of Sheriff Sergeant Luis Dejesus Aquino several times they have refused. They have never provided the Booking photo to any News provider.
The Palo Alto Daily Post (The only print media) article October 25, 2019 by Emily Mibach
“The Post only learned of this arrest once Wagstaffe’s office yesterday arraigned Aquino on the charges of refusing to submit to a Breathalyzer test and DUI. The Post routinely gets lists of recent arrestees from Redwood City police, but Aquino is not listed on the log for either Sept. 14 or 15.”
